Day 035 - 12 Oct 94 - Page 08

quite a lot of television work?
       A. Yes, I do.

  Q. You remember I put it to you that you had on that
programme said words to the effect that 25 per cent of
meat eating men would become impotent.

MS. STEEL: By "eating meat" you said.

MR. RAMPTON: By eating meat, yes, and you said, "No", you
would never have said such a thing at all. Can I put
something else to you now and then perhaps we can look at
the two extracts and any other bits you may wish the court
to see? Did you say on that television programme that 35
to 50 per cent of cancers are due to diet?
       A. I believe I said words to that effect, yes.

  Q. If you did say that it would not be an accurate statement
of scientific knowledge at the time when you said it,
       would it?
       A. It would be an accurate statement.

  Q. It would. You cited, I think, in support of that
statement, statistics or statements made by the National
Cancer Institute of the United States?
       A. I did.

  Q. My Lord, maybe in the light of that it would be
appropriate for your Lordship to see those two short
       parts?

MR. MORRIS: Can we ask Dr. Barnard to write down the exact
       words that he said?

THE WITNESS: Thank you. I have already had the opportunity to
write down the first of those segments and to compare it
with what Mr. Rampton presented me with yesterday and I
have noted the differences. I did not get an opportunity
to write down the second quote. Would it be helpful for
       me to do that?

MR. JUSTICE BELL: Let us see it.

(The extract of Cross-Talk video was played to the court)

MR. MORRIS: Did you get the exact wording?

MR. JUSTICE BELL: Someone has got to sit down -- not now --
and actually make an accurate transcript. You then check
       that it is accurate.

MR. RAMPTON: It is a skilled business that and we will have it
       done professionally.

MR. JUSTICE BELL: It is bad enough when people are speaking at
normal speed in court. When they are getting excited on
chat shows and interrupting each other, all talking at the
same time, it is very difficult. If points are going to
be made on this, I need a transcript which is agreed by
       the parties to be accurate.
