Day 037 - 14 Oct 94 - Page 07

MR. JUSTICE BELL: What I am particularly interested in is your
evidence as to McDonald's promotion of its foods; the
reason being that it may be that the nutrition element in
this case falls into two parts, the extent to which foods
of the kind served by McDonald's may be associated and to
what extent with ill-health, and the extent to which
McDonald's gives information it should do about its food,
or promotes it as healthy food when it is being argued
that it is not, in fact.
       A. Yes.

  Q. I think you are in the second compartment rather than the
       first.

MR. MORRIS: You are not a dietician, are you?
       A. No.

MR. RAMPTON: Might I intervene at this stage with a view to
least inconvenience to Mr. Cox and everybody else. If
there is an article published in the BMJ about what
Mr. Cox may well have described as deceptive marketing of
meat products, which he, I think, described as an angry
article, and reliance is placed on that in two ways, first
       because it no doubt sets out some of Mr. Cox's views;
secondly, in order no burnish Mr. Cox's credibility as a
witness that he has had an article accepted by the BMJ, I
think we ought to have it. If we are told what issue it
is in, then we can make arrangements to obtain a copy
before Mr. Cox leaves the witness box. I do not believe
it is one of his references.

MR. JUSTICE BELL: Your statement spoke of being asked to write
and it has actually been published, we understand, from
       what you have just said?
       A. Yes, my Lord.

  Q. Can you remember which issue it was in? Do you actually
       have a copy you?
       A. I do not with me, no. My research material is almost
as extensive as yours here. Mr. Rampton is incorrect in
saying it was published in the BMJ; it was published in
the BMA's News Review, as I made clear.

MR. RAMPTON: I am sorry. That is my bad hearing.

MR. JUSTICE BELL: Can you pin it down for us when abouts it
       was?
       A. I am pretty sure I can.

  Q. Is that monthly or quarterly?
       A. It was monthly.

  Q. About which month?
       A. I think it was May last year, but .....

  Q. Some time this late spring or early summer, you think?
       A. Yes. If I am going to be here on Monday, I will
willingly bring it with me then.
