Day 082 - 01 Feb 95 - Page 09
there would not need to be directions on the application
for discovery that we made then.

Quite a number of the things that they were looking into,
we have not heard what they found. On the Brazil,
specifically, then they did disclose a map. They did say
when they disclosed it that they were not sure if this was
the map that they were looking for or not, because it did
not have any information on it to really say -----

MR. JUSTICE BELL: No, you need not go into any argument, just
"Brazil map". Give headlines of that kind.

MR. MORRIS: Yes, and related documents that were indicated,
I am just giving so that the Plaintiffs can look at the
argument that there was last time. There is no point in
repeating all the arguments we had last time. They should
check.

MR. JUSTICE BELL: Documents which you say there was an
indication of further enquiry on day 70, the Braslo map?

MR. MORRIS: Yes.

MR. RAMPTON: My Lord, I hesitate to interrupt, you see, this is
what happens. It is such a muddle. Your Lordship has
actually made a formal ruling in relation to Brazil. That
ruling was made on 20th December. We know what we have to
do in relation to Brazil; we have to disclose documents
which are relevant to the question, if we have any, or had
any, relevant to the question where in Brazil the Vesty
meat came from. That is all.

MR. MORRIS: The rulings you made were not exhaustive because
the Plaintiffs were making a number of indications that
they were looking into other areas which meant that you
would not have to make a ruling one way or the other,
whether they were under obligation to do that. If the
Plaintiffs check, they may be surprised to find that they
are actually at the moment making lots of enquiries for
documents.

MR. JUSTICE BELL: Yes. Is there anything else in relation to
Brazil? I will re-read that myself.

MR. MORRIS: Yes. Actually, I was going to ask you if you could
re-read pages 16 to 20.

MR. JUSTICE BELL: Is this day 70?

MR. MORRIS: On day 70, because, if you remember, we had a
discussion about what our case was on the rainforest issue.

MR. JUSTICE BELL: Yes.

MR. MORRIS: And that although you were concentrating on the
discovery issue, it did not necessarily prejudice our ---

MR. JUSTICE BELL: Yes, I remember that.
