3 Q. But were you responsible for the development?
4 A. Operations development of new products, new ways of
5 operating a restaurant, new equipment and changes, anything
6 that was changing in McDonald's. That is really what I was
7 responsible for, heading up various teams on new ideas.

9 Q. So, in fact, it would have been a relevant circumstance for
10 you, even if you were not personally in a responsible
11 position, in terms of monitoring equipment and procedures
12 to see if things could be improved?
13 A. Yes, I think you could make that association but -----

15 Q. It is now, is it not, it is now in your area of
16 responsibility in terms of health and safety of employees?
17 A. Most definitely now with my new responsibility of
18 health and safety, reporting directly to me is my
19 responsibility.

21 Q. Would you say that was the most serious incident in terms
22 of implication for employees' safety that there has been in
23 McDonald's in this country?
24 A. You said is that the most serious implication?

26 Q. Is that the most serious single incident that has ever
27 happened, as far as you know of, in McDonald's in this
28 country?
29 A. To my knowledge, I believe there has only been one
30 death of anyone in McDonald's.

32 MR. JUSTICE BELL: Is it the only fatality?
33 A. Yes, as far as I am concerned, I am sure it is.

35 MR. MORRIS: So you would say that was the single most serious
36 individual incident?
37 A. Well, yes, a death is more serious than any other
38 accident that has happened in McDonald's.

40 Q. You are now presently in charge of the over-view of health
41 and safety of employees?
42 A. That is correct.

44 Q. So you would have to know something about that incident if
45 it was not to be repeated, would you not?
46 A. I know the broad history of that accident, yes.

48 Q. So you do not know of any fault of McDonald's for that most
49 serious accident in the company's history?
50 A. I do not. As I say, I just know from conversations
51 with Jill and just a general overview of health and safety
52 in the past, some of the circumstances that were there. I
53 just say again that Jill was the person who has, I think,
54 managed that situation and understood all aspects around
55 that. She needed to know it. At that time it just was not
56 an issue that I managed.

59 reports or in any meetings as something to be taken
60 seriously or to remember or to note certain circumstances
