Day 086 - 09 Feb 95 - Page 05

       Mr. Stiles.

MR. RAMPTON: My Lord, I have something to say, if I may?

MR. JUSTICE BELL: I would like, before anyone says anything, to
       look at Ms. Barnes' -----

MR. RAMPTON: Yes, my Lord, that will be, I think, volume X of
the yellow. My Lord, it is her second statement. It is at
tab 14. That statement is devoted exclusively to the Mark
       Hopkins' incident.

MR. MORRIS: Sorry, what tab was it?

  MR. JUSTICE BELL: 14. Yes.

MR. RAMPTON: My Lord, it goes further than Mrs. Barnes'
statement because in volume XIII of the yellow files there
is a report or statement by the Senior Environmental Health
Officer regarding the incident, the Senior Environmental
Health Officer of Manchester, made very nearly
contemporaneously with the accident itself. That is
subject presently of a Civil Evidence Act Notice.

MR. JUSTICE BELL: Yes, which one is that in?

MR. RAMPTON: My Lord, that is tab 39 of volume XIII of the
       yellow files.

  MR. JUSTICE BELL: Mr. McShirkie.

MR. RAMPTON: Your Lordship will also find it, it may be more
       convenient ---

MR. JUSTICE BELL: I have this out now.

MR. RAMPTON: -- then it is tab 39. Mr. Michael McShirkie or it
is M. McShirkie, I think his name is Michael, but I am not
sure. But there is also a copy of his report in the pink
volume but that does not matter. My Lord, what I was going
       to say was this -----

MR. MORRIS: I hope Mr. Rampton is not going to say anything he
       should not say.

MR. RAMPTON: I am making objection to Mr. Morris'
       cross-examination of this witness.

MR. MORRIS: I have not started yet.

MR. RAMPTON: Yes, and I make it now.

MR. JUSTICE BELL: Let me just hear what he is going to say.

MR. MORRIS: I think the witness should leave the room then.

MR. JUSTICE BELL: Very well. You can ask for that. You know
you can ask for that. (To the witness): Would you leave
the court, please? If Mr. Rampton stands up, please sit
       down.
