Day 101 - 10 Mar 95 - Page 21

MR. MORRIS: Sorry, I did not understand.

MR. JUSTICE BELL: If you do not understand, you must sit down
now and do a bit of transcript reading because I have ruled
on this on several occasions in the past, certainly more
than once. You must move on with the remainder of your
cross-examination on the food poisoning. If you want to
have a five-minute break, do so, and we will then, if there
are any relics on food poisoning, deal with them after the
break and then we will go straight on to animal welfare
       from there.

MR. MORRIS: We are going to move on, but I would just point out
that the pleadings, although they may strictly be under
nutrition on this particular matter, do relate to obviously
cross-fertilization with the food poisoning issue because
the lettuce matters are pleaded; what we make of it is
       another question.

MR. JUSTICE BELL: Hold on, you cannot say "lettuce matters" are
pleaded as if the appearance of the word "lettuce" enables
you to ask any question about lettuce. If you can point me
somewhere where pesticide residues in lettuce is pleaded,
fair enough. If you cannot point to that, if you can point
to something which on a statement raises pesticide residues
in lettuce, point me to that.

What you cannot do is say: "A lettuce has floated over the
horizon so I can blast away at it as often as I like and as
       much as I like".

MR. MORRIS: I know, with respect, we have only brought it up
for about 20 minutes in 100 days.

MR. JUSTICE BELL: Please leave it now. Do you want the
five-minute break there just in case there is anything on
food poisoning you want to raise? I will come back at 5 to
12 which is eight minutes, certainly more than five, but
then, when you have finished your food poisoning, I would
like to go straight on to animal welfare.

                      (Short Adjournment)

MS. STEEL: In the mornings when staff go into McDonald's,
maggots are sometimes found in shake machines, are they
       not?
       A. Not that I am aware of.

  Q. You have not heard of that?
       A. I have nothing to do with the in-store operations.
I told you this yesterday. The shake machine and the
cleaning of the shake machine is something that is done
last thing at night and first thing in the morning, and is
the remit of the Operations Department.

  Q. So your department has never investigated anything to do
       with that?
       A. No.

  Q. Not at all?
