Day 103 - 14 Mar 95 - Page 23

  Q. They do do?
       A. Some bacteria will grow at very low temperatures. The
common spoilage organisms that would affect chicken would
not grow at four degrees or below.

  Q. Staphylococcus faeceum, is that something that would affect
       raw chicken?
       A. No.

  Q. If we go back to the previous page under Cholavi at the
end, there is a 5.20 maximum temperature not rejected -----

MR. JUSTICE BELL: Hold on. That may be a conclusion you draw
from the other answer, but it does not say that on the
       sheet.

MR. MORRIS: Mr. Pattison did say and it would not be -----

MR. JUSTICE BELL: Yes, I know. You ask him about it. Put it
       to him.

MR. MORRIS: If a bin is not rejected and it is at that
temperature, is that a human error or is that a failure of
       the system?
       A. I cannot speak for this individual case or the choice
of the individual at the particular time. What I would say
is that the standard that we are setting is way above the
legislative -- any legislative requirements for transport
       of food.

MR. JUSTICE BELL: What is that?
       A. The current recommendation is eight degrees Centigrade
for the transport of chilled foods.

  Q. Do you know what it would have been in about 1989? Would
it have been the same or moved around?
       A. The regulations, since the heightened awareness about
listeria, the requirements have been tightened, but I am
not sure that I can remember what it was before if, in
fact, there were any strict regulations on that.

MR. MORRIS: If we go back to the page 2 again, I notice, while
we are looking at the foreign objects found, yes, that some
of the foreign objects are not chicken related; that means
they are plastic or metal or things like that, yes?
       A. Could be, yes.

  Q. In fact, as many non-chicken related foreign objects are
being found as chicken-related in the first two, Grandstand
       Road and Jamain, yes?
       A. Yes.

  Q. Down on the left-hand bottom box, Raw Materials Laboratory
Analysis, it says above 500,000, is that your limit?
       A. Yes.

  Q. Or acceptance?
       A. The 500 -----
