Day 105 - 16 Mar 95 - Page 02
Thursday, 16th March 1995.

MR. JUSTICE BELL: What was the problem this morning?

MR. MORRIS: I have got some problems with the school. The
school has found asbestos in the school. I thought he
would be going back to school today but I had to get a last
minute emergency.

MR. JUSTICE BELL: You must ensure that you get here comfortably
before half past 10. Do not aim at the stroke of half past
10 because that means we are always late. Provided one of
you is here for cross-examination, the other can continue.
We can go on if one of you is a bit late. It may only be
three or four minutes, but they do add up over the period
of time, so do make sure that you get here comfortably
before half past 10.

It is not something I like to do but, technically, if the
witness is here at half past 10 to be cross-examined by you
and you are not here, as far as I am concerned, he can
leave the witness box and the court and go about his
business because you have not been here to continue
cross-examination and there would be no question of asking
him to be recalled. So, do bear it in mind. You have been
pretty good most of time, but it is irritating.

MS. STEEL: There have been times when the Plaintiffs have been
late and nothing is said to them. We had to wait 10
minutes for Mr. Pattison yesterday and nothing was said
about that.

MR. JUSTICE BELL: Just bear it in mind. There was no
explanation given at all for coming in late. Make sure you
are on time. On one occasion when I think McDonald's
representatives were not here, it may have been oversight
or not, I came in and we started, and they came in a moment
or two later and we carried on.

MR. RAMPTON: I hope I was here.

MR. JUSTICE BELL: I think you were. It is the sort of thing
that happens from time to time and we must keep to the
clock. Yes?

MR. MORRIS: The other problem is I was sent some papers by
Ms. Hovi last week and they did not arrive in the post, so
that is another problem. They are comments on the
Jarretts' documents.

MR. JUSTICE BELL: Let us get on with Mr. Bennett.

MR. DONALD BENNETT, recalled.
Cross-examined by the Defendants, continued.

MR. MORRIS: You had some relationship with the Health & Safety
Executive; is that correct?
A. Yes, it is.

Q. Was that on the occupational side or was that on the food
