     3   MR. JUSTICE BELL:  What was the problem this morning?

     5   MR. MORRIS:  I have got some problems with the school.  The
     6        school has found asbestos in the school.  I thought he
     7        would be going back to school today but I had to get a last
     8        minute emergency.

    10   MR. JUSTICE BELL:  You must ensure that you get here comfortably
    11        before half past 10.  Do not aim at the stroke of half past
    12        10 because that means we are always late.  Provided one of
    13        you is here for cross-examination, the other can continue.
    14        We can go on if one of you is a bit late.  It may only be
    15        three or four minutes, but they do add up over the period
    16        of time, so do make sure that you get here comfortably
    17        before half past 10.

    19        It is not something I like to do but, technically, if the
    20        witness is here at half past 10 to be cross-examined by you
    21        and you are not here, as far as I am concerned, he can
    22        leave the witness box and the court and go about his
    23        business because you have not been here to continue
    24        cross-examination and there would be no question of asking
    25        him to be recalled.  So, do bear it in mind.  You have been
    26        pretty good most of time, but it is irritating.

    28   MS. STEEL:  There have been times when the Plaintiffs have been
    29        late and nothing is said to them.  We had to wait 10
    30        minutes for Mr. Pattison yesterday and nothing was said
    31        about that.

    33   MR. JUSTICE BELL:  Just bear it in mind.  There was no
    34        explanation given at all for coming in late.  Make sure you
    35        are on time.  On one occasion when I think McDonald's
    36        representatives were not here, it may have been oversight
    37        or not, I came in and we started, and they came in a moment
    38        or two later and we carried on.

    40   MR. RAMPTON:  I hope I was here.

    42   MR. JUSTICE BELL:  I think you were.  It is the sort of thing
    43        that happens from time to time and we must keep to the
    44        clock.  Yes?

    46   MR. MORRIS:  The other problem is I was sent some papers by
    47        Ms. Hovi last week and they did not arrive in the post, so
    48        that is another problem.  They are comments on the
    49        Jarretts' documents.
