Day 110 - 29 Mar 95 - Page 13
to get the measure of the areas within which Mr. Long can
give admissible evidence.

MS. STEEL: Mr. Long has considerable experience and expertise
in cattle. Can I -----

MR. JUSTICE BELL: No, you cannot. Let us just look at the
topics. I am not asking you to persuade me that he can
give expert evidence on a topic, I want to see the
topic -----

MS. STEEL: I just want to ask answer something Mr. Rampton
said. He said he cannot give any expert evidence about
cows that are going to McDonald's. The fact is McDonald's
do not know where their cows are coming from. So, if
Mr. Long can talk about the cattle industry, in general,
that is going to be applicable to McDonald's, the cows that
go to McDonald's.

MR. JUSTICE BELL: Are you not going to allow me to go through
his statement so that you can make that point as each topic
comes up? The first thing is not that point at all,
because he positively says that he has witnessed at
livestock markets culled dairy cows being auctioned and
bought to be slaughtered for McDonald's burgers.

All I am asking is, do you know whether he can expand on
that and what the compass of his evidence is to demonstrate
that they are going to McDonald's?

MR. MORRIS: The reason that this came up was that McDonald's
were denying or claiming that there was no evidence that
they used any dairy cattle whatsoever in this country. It
was not put in in order to be evidence of the fact -- it
was not put in so that Dr. Long could establish his
expertise as relevant to McDonald's cattle.

MR. JUSTICE BELL: Mr. Morris, I am going stop you there. I
would like you to answer my question. If the answer is you
do not know, say so.

MR. MORRIS: I do not know. As it turned out, McDonald's use at
least 50 per cent of its dairy cattle -- surprise,
surprise.

MS. STEEL: Can I make another observation about the statement
of Mr. Long?

MR. JUSTICE BELL: Yes.

MS. STEEL: He does say at the end of it that he rushed it off
between visits. I think he had only about two or three
days to prepare this. It may if he had longer, he would
have prepared something a bit more detailed.

MR. JUSTICE BELL: Do you know how long he is likely to take
giving his evidence-in-chief?

MS. STEEL: He has got considerable experience not only in
cattle, but in pigs and poultry as well which is mentioned
