Day 110 - 29 Mar 95 - Page 18

MS. STEEL: I think it was 6th February.

MR. MORRIS: Yes, I have 6th February. It certainly was
       discussed on 6th February.

MR. JUSTICE BELL: Let us leave it there for the moment. I will
try to find it but I think it was mentioned after that.
I assume it may have been mentioned some time during the
week when I gave my ruling which, I think, was Monday, 27th
       February.

Mr. Rampton, I am not going to enquire any further into the
question of Mr. Long and Mr. Tyler.

MR. RAMPTON: I did not expect your Lordship would. I said what
I did because I am not going to be silent as I was during
the evidence of Mrs. Druce. In fact, Mr. Morris is quite
wrong about the need for cross-examination of witnesses who
portray their lack of qualifications and expertise out of
their own mouths in-chief, then I do not have to
       cross-examine.

What I am concerned with is the waste of McDonald's time
and the waste of McDonald's money. So, I am encouraging
the Defendants to stick to relevant evidence. If they do
       not, I will interject.

MR. JUSTICE BELL: If there is any objection, I will rule on it
at the time. I do not think there is anything further
I can say about that now. Was there anything further you
wanted to say in relation to employment, Brazil or
       Mr. Nicholson?

MR. RAMPTON: No, my Lord. I will reserve my position on that.
We will see what comes out in the wash when the 14 days are
up and we will see the Defendants' list of witnesses that
       are coming to court.

MR. MORRIS: We have a list of witnesses coming to court
already. Their statements were disclosed two years ago.

MR. RAMPTON: My Lord, the other thing that remains, I would
like to deal with Brazil as soon as possible for reasons
your Lordship has mentioned. If it is going to be
disallowed for the various reasons which I have not yet
addressed your Lordship about, then let us get it out of
the way as soon as possible. If any part is going to be
allowed in with discovery implications, then I should need
time to see whether any relevant documents exist or not
and, if so, get them to this country, so the sooner that is
       dealt with the better.

My Lord, Mr. Nicholson is the only remaining witness
I wanted to mention. The suggestion was made yesterday,
I think, because the Defendants felt uneasy about having to
prepare cross-examine him on both parts of his evidence,
that is to say employment and publication.

The suggestion was made by the Defendants that the
