  Q. But are the practices outlined there in the managerial
responsibilities in accordance with what you expect of
       managers in the McOpco stores?
       A. I have no idea what you just said.

  Q. It is correct, is it not, that managers assign the work and
prepare and post weekly work schedules both in -- let us
just deal with McOpco ones, the McOpco stores?
       A. Yes, sure, of course.

  Q. It is correct that they would discuss performance reviews
       with employees?
       A. Absolutely.

  Q. That pay rises are governed by a system wide scale?
       A. That they would -----

MR. JUSTICE BELL: What Mr. Stein has said, he disputes "system
wide scale" if you mean rate of pay. But what he thinks it
must mean is this system of reviews leading possibly to pay
       rises.

MS. STEEL: OK. If it is in terms of reviews, then you would
       accept that?
       A. Yes.

  Q. They suspend employees?
       A. Yes, they would have that right to do that, sure.

  Q. They have told employees to punch out and go home for
       various reasons?
       A. Yes, they would have authority to do that.

  Q. And they have the power to grant time off?
       A. Yes, very definitely.

  Q. Employees are required to have permission from a Manager
before leaving their assigned duties for any reason?
       A. Yes. I will make sure that your understanding and my
understanding is the same: If you are work in a particular
area and the entire team is expecting something you are
doing to fit into their team, the Manager wants to make
sure that there is someone there, and that there is not
this gap that interferes with the process of serving
customers or interferes with the work of other employees.
Our employees work together, and what this is really saying
is: "Hey, if you want to leave your station, just make
sure that you let the Manager know so that he or she can
       cover that area for you".

  Q. Also whilst the crew are working the close and cleaning up
and what-have-you, they would have to get permission before
       they could leave from that?
       A. What they would do is they are generally scheduled to
work a certain time and generally they would be leaving at
that time. I am not sure what you are getting at.

  Q. But if the close took longer than expected -----
