Day 143 - 27 Jun 95 - Page 24

have put the question on more than one occasion. I have
just to see what other evidence there is in the case.
I have some witnesses on this already. You are going to
call your witnesses. At the end of the day, I may have to
decide whether that is a realistic answer of Mr. Stein's or
not, but I will make the decision when I have heard all the
evidence. It is not helpful, I would suggest, if you do
not like the answer just to go over it again.

  MS. STEEL: No.

MR. JUSTICE BELL: Let us see what other evidence there is.

MS. STEEL: There is just one thing I wanted to ask: If you are
so keen to have your employees satisfied, Mr. Stein, why do
you not pay them double the wages? They would be happier
       then, would they not?

MR. JUSTICE BELL: Do not answer that question. That is a
matter of comment as well. I will have to decide whether
it is a comment of this world or some other one I have not
       yet lived in.

MS. STEEL: It is correct, is it not, Mr. Stein, that employees
at McDonald's do not get holiday pay, crew members?
       A. They are paid on holidays, if that is your question.

  Q. What does that mean?
       A. They receive wages when they work on holidays.

  Q. You mean when they work on -- I do not know what you call
it over there -- what we call Bank Holiday?
       A. I think you are -- are you referring to what we would
       call legal holidays?

  MR. JUSTICE BELL: Yes.
       A. OK. When they work, well, whenever they work they are
       paid.

MS. STEEL: But if they want to take an annual vacation, take
two weeks off work, they do not get paid for that, do they?
       A. Generally speaking, no.

MR. JUSTICE BELL: You are speaking of the USA now, are you?
       A. Yes, my Lord. That is what I thought we were limiting
this line of questions to. If I am wrong -----

MS. STEEL: No, I was talking about the USA. Does McDonald's in
the US have a policy of not allowing crew to work more than
       40 hours a week?
       A. It does not have a policy against that. We would
prefer that they not work more than 40.

  Q. Is that basically because you do not want to have to pay
       overtime rates?
       A. We would like not to have to pay overtime, but it
       has ------

MR. RAMPTON: My Lord, I believe that there is an inconsistency
       in the Defendants' case ------
