5 MR. RAMPTON: My Lord, does your Lordship have our agenda, our
6 typed written agenda ---

8 MR. JUSTICE BELL: Yes.

10 MR. RAMPTON: -- that we handed up a few days ago.

12 MR. JUSTICE BELL: Yes.

14 MR. RAMPTON: Can I tell your Lordship the order in which,
15 subject to any feelings your Lordship may have about the
16 matter, the order in which I would like to deal with the
17 items on our agenda? I want to start with something which
18 is not on the agenda which is the matter I mentioned
19 briefly in open court at the end of last week.

21 MS. STEEL: Can I say, if this is -- I do not know -- but when
22 we actually asked the Plaintiffs about this after court, we
23 were told we were going to be sent a letter about this and
24 we have not received it, so we are not entirely sure what
25 this is about. So, I think it would be better if we got
26 the letters and then had time to talk to somebody about it.

28 MR. RAMPTON: I am told there was no letter promised; I do not
29 propose to send -----

31 MS. STEEL: There was.

33 MR. RAMPTON: I do not propose to send a letter. A letter has
34 already been written on this topic on 10th March of last
35 without any response from the Defendants.

37 MS. STEEL: I want to refute that. I was told on Friday evening
38 we would be sent a letter about this, most definitely.

40 MR. JUSTICE BELL: Let us hear what it is and then if you are
41 caught out in any way and need more time we will consider
42 that.

44 MR. RAMPTON: It is not an application. It is something I feel
45 duty bound as counsel in the case to mention to your
46 Lordship, because I would very much appreciate having your
47 Lordship's view before my clients make any decision on the
48 matter. My Lord, after that, I will go, if I may, straight
49 to item 7 which is scheduling. Then to item 6, then to
50 item 2, then to item 10 which is, perhaps, really part of
51 7. Then after 10, the Hovi question, Hovi/Bone question
52 which is 9.

54 Then I will sit down after that and leave Mr. Atkinson to
55 deal with items 3 and 5 in whichever order he prefers. The
56 reason for that is that I am not up to speed on the
57 counterclaim and he is the master of that. So, if your
58 Lordship will permit me, I will leave items 3 and 5 to
59 him. All the others, I believe, we have already dealt with
60 on our list.
