1 My Lord, I will hand that copy of those statements with one
2 of Mrs. Brinley-Codd's directions about where to put them.
3 Then there is a Mr. Tindale who deals in an oblique or
4 indirect way with that film, the Defendants' witness in
5 relation to that film and other matters besides being Anne
6 Tobin. Then, my Lord, finally for the moment there is a
7 man called James Atkinson. He deals with the evidence of a
8 witness of the Defendants who is abroad called Nicholas
9 McGill who says that he worked at the Marble Arch
10 restaurant. Mr. Atkinson was the Marble Arch Manager at
11 the time. My Lord, what we have done with the exception of
12 Mr. Ravalia ----

14 MR. JUSTICE BELL: Were you including ----

16 MR. RAMPTON: My Lord, what we have done, so far as possible, is
17 to confine our witnesses to answer the evidence of the
18 Defendants' witnesses that we know are coming to court, or
19 we have been told are definitely coming to court, and also
20 those of their Civil Evidence Act witnesses which we have
21 not so far answered. For example Mr. Giardina, who is now,
22 I think, an Operations Manager in this country, answers the
23 evidence of Mr. Dave Magee who is a Civil Evidence Act
24 witness in relation, I think it was, to Seven Sisters.
25 Mr. McGill is another one.

27 There are some, it has to be said, that we simply cannot
28 find. We do not know the name, recognise the name, of the
29 Defendants' witness and we have not been able to find
30 anybody to answer them, but that is just bad luck on us.

32 What we have not done, my Lord, is to list anybody who
33 deals with a Defendants' witness who we have not been told
34 for sure is coming to court.

36 My Lord, if that works out (as I hope that it will), that
37 evidence should take us right through until the end of
38 term. It is our intention to have somebody available for
39 the Friday afternoon of next week, Friday 14th -- sorry,
40 the whole of Friday -- in case (which is possible)
41 Mr. Davies should finish on Thursday, 13th. Thereafter, we
42 will list them with as much proximity to each other as is
43 consonant with good sense and past experience.

45 My Lord, we do intend so far as possible to hurry along
46 through this part of the case now that we have got here and
47 now that we have past Mr. Stein, bearing in mind your
48 Lordship is not sitting from July 26th onwards.

50 MR. JUSTICE BELL: In case I forget to mention it later, the
51 list of judges' movements which I was recently sent has put
52 me down sitting from Monday, 25th September. The people
53 responsible for judges' movements were told that I might
54 well do that. I will hear anything anyone wants to say
55 about it, but I propose to sit on 25th September unless
56 there is some serious difficulty so far as any party is
57 concerned, really, to essentially make up the time we will
58 lose from the last Wednesday of term onwards.

60 MR. RAMPTON: With any luck, and subject to another scheduling
