     1        chambers rather than open court.  Mr. Rampton made a point
     2        that he wanted to make it in chambers for the Defendants'
     3        sake.  The Defendants have said that they are happy to have
     4        it heard in open court.  Therefore, any further discussion
     5        on it will be in open court.

     7        If at any stage any party wishes to argue that anything to
     8        be discussed in the course of the trial should be discussed
     9        in chambers, I will hear what they have to say.

    11        Mr. Rampton, you are perfectly entitled to say anything you
    12        wish on the question of CaseView or the transcript in open
    13        court, because I have to go back to my room and put my
    14        robes on.  I am afraid we had better put our wigs on or, as
    15        I have said before, someone will think, on a coolish day
    16        like this, I was trying to make some statement.

    22   MR. RAMPTON:  No.  I have to go all the way back to chambers,
    23        I am afraid, which is only the other side of the Strand.

    26        reply.  Your Lordship will, I hope, forgive me if by way of
    27        reply to what the Defendants have to say (and it might be a
    28        case where your Lordship thought it right that I should
    29        respond immediately, rather than waiting to the end of the
    30        interlocutory hearings), I will -----

    32   MR. JUSTICE BELL:  Before Ms. Steel and Mr. Morris respond to
    33        the applications which you and Mr. Atkinson made yesterday,
    34        I consider that the question of CaseView and the transcript
    35        should be canvassed, in the sense that I will allow
    36        Ms. Steel and Mr. Morris to say anything which they wish to
    37        say about that.  Then I will hear anything which you wish
    38        to say in reply to whatever they say.

    40   MR. RAMPTON:  What I was going to say was, if your Lordship
    41        would do that, I would ask to be forgiven if I repeat in
    42        summary what I said yesterday.

    44   MR. JUSTICE BELL:  You must say whatever you would like,
    45        Mr. Rampton.  I will come back into court -- I do not see
    46        why you should rush back to Chambers -- five past 12, and
    47        we will resume then in open court.
