Day 148 - 05 Jul 95 - Page 08

MS. STEEL: I want to reserve the right to make an application
       for them to be recalled.

MR. JUSTICE BELL: Yes. You have always got the right to make
such an application. If you do make such an application,
I will decide it on its merits when it is made.

MR. RAMPTON: My Lord, that said, can I then tell your Lordship
what our proposal is? As I told your Lordship, Mr. Stanton
tomorrow, going through, if need be, until Monday; then
Mr. Davies on Tuesday. Because we cannot find any of the
employment witnesses for Friday 14th and Monday 17th we
have put Mr. Fairgrieve back in there. There cannot be any
       worry about that.

MR. MORRIS: Sorry, where is this?

MR. RAMPTON: Friday 14th. He will be here, if he is needed, on
Friday 14th and we have listed him also for Monday 17th.
Then, my Lord, on Tuesday 18th Florence Farrer, and, if he
is reached on that day, Mr. Giardina following her because
they are the same restaurant and Mr. Giardina on the 19th.
Then on the 20th Annette Hall. My Lord, I should say --
Mrs. Brinley-Codd reminds me -- she is on maternity leave
and is nursing her child. I hope that will be all right.

Then on Friday 21st Almass Antena, who is the Strand from
One Every Mile. She is also provisionally listed for the
morning of the 24th, afternoon of the 24th, although
perhaps earlier Mr. James Atkinson to finish, if need be,
on 25th, and that is the lot.

MR. JUSTICE BELL: I would be grateful if someone -- I have not
taken all those down -- can give me a copy of the list.
I do not need it at this moment but in due course. What
I was going to suggest is that if Ms. Steel or Mr. Morris
want to bring back the question of amendments to Defence
pleadings and any application they want to make in relation
to the nutrition issue before the end of this term, they
should do it on Monday 17th or as soon as we finish any
witness who, for instance, might not have been completed on
the Friday. That is the indication I give.

MR. RAMPTON: My Lord, that is well understood. It may mean, of
course, that poor Mr. Fairgrieve has to go off into limbo
       yet again.

MR. JUSTICE BELL: No. As soon as we have finished him -- I
see, you mean if we do not get to him on the Friday?

MR. RAMPTON: Suppose Mr. Davies was in the witness box for four
days instead of three, he is clear both Friday and Monday
-- not that he is going to be needed on both days --
whether he is likely to be needed on one or the other.

MR. JUSTICE BELL: If you then say, "I would like to start
Mr. Fairgrieve" and we end up doing the Defendants'
applications on, say, the Wednesday, I am not concerned
about that. But I think you ought to aim at the first half
of the week which begins on Monday 17th for the reasons
