5 such an application. If you do make such an application,
6 I will decide it on its merits when it is made.

8 MR. RAMPTON: My Lord, that said, can I then tell your Lordship
9 what our proposal is? As I told your Lordship, Mr. Stanton
10 tomorrow, going through, if need be, until Monday; then
11 Mr. Davies on Tuesday. Because we cannot find any of the
12 employment witnesses for Friday 14th and Monday 17th we
13 have put Mr. Fairgrieve back in there. There cannot be any
14 worry about that.

16 MR. MORRIS: Sorry, where is this?

18 MR. RAMPTON: Friday 14th. He will be here, if he is needed, on
19 Friday 14th and we have listed him also for Monday 17th.
20 Then, my Lord, on Tuesday 18th Florence Farrer, and, if he
21 is reached on that day, Mr. Giardina following her because
22 they are the same restaurant and Mr. Giardina on the 19th.
23 Then on the 20th Annette Hall. My Lord, I should say --
24 Mrs. Brinley-Codd reminds me -- she is on maternity leave
25 and is nursing her child. I hope that will be all right.

27 Then on Friday 21st Almass Antena, who is the Strand from
28 One Every Mile. She is also provisionally listed for the
29 morning of the 24th, afternoon of the 24th, although
30 perhaps earlier Mr. James Atkinson to finish, if need be,
31 on 25th, and that is the lot.

33 MR. JUSTICE BELL: I would be grateful if someone -- I have not
34 taken all those down -- can give me a copy of the list.
35 I do not need it at this moment but in due course. What
36 I was going to suggest is that if Ms. Steel or Mr. Morris
37 want to bring back the question of amendments to Defence
38 pleadings and any application they want to make in relation
39 to the nutrition issue before the end of this term, they
40 should do it on Monday 17th or as soon as we finish any
41 witness who, for instance, might not have been completed on
42 the Friday. That is the indication I give.

44 MR. RAMPTON: My Lord, that is well understood. It may mean, of
45 course, that poor Mr. Fairgrieve has to go off into limbo
46 yet again.

48 MR. JUSTICE BELL: No. As soon as we have finished him -- I
49 see, you mean if we do not get to him on the Friday?

51 MR. RAMPTON: Suppose Mr. Davies was in the witness box for four
52 days instead of three, he is clear both Friday and Monday
53 -- not that he is going to be needed on both days --
54 whether he is likely to be needed on one or the other.

57 Mr. Fairgrieve" and we end up doing the Defendants'
58 applications on, say, the Wednesday, I am not concerned
59 about that. But I think you ought to aim at the first half
60 of the week which begins on Monday 17th for the reasons
