     6   MR. MORRIS:  We will certainly be finished by lunchtime, if not
     7        well before.

     9        (To the witness)  Just one question about in the Strand
    10        restaurant.  The crew had to report to the Shift Running
    11        Manager to ask for permission to leave, yes, when they
    12        finished a shift?
    13        A.  That is correct.

    15   Q.   We might be finished in about quarter of an hour, ten
    16        minutes.  In your statement, regarding the departure of
    17        Michael Metcalfe, you say:

    19        "I recall that at the time of his departure a similar
    20        allegation was made about the number of hours he worked.
    21        I remember checking the schedule and noted he was scheduled
    22        for the regulation five shifts in a week.  Thus, 97 hours
    23        in a week is probably an exaggeration, although it was fair
    24        to say tht Michael was ambitious and, therefore, put in
    25        extra hours in order to impress.  It is certainly was not
    26        necessary for him to spend that amount of time in the
    27        restaurant in order to complete his duties."

    29        Do you say that was a fair summary of what you recall?
    30        A.  Yes.

    32   MR. JUSTICE BELL:  Could I just ask about the 97 hours, so that
    33        if I do any arithmetic I do it on a sound basis.  Would
    34        someone like Michael Metcalfe ever work more than five days
    35        a week or five shifts a week?
    36        A.  Yes.

    38   Q.   What is the maximum number of shifts he would work in a
    39        week?
    40        A.  Six.

    42   Q.   Six.  So, in order to clock up 97 hours, if it was a six
    43        shift week, the shifts would have to average 16 hours a
    44        week; that would make 96?
    45        A.  Yes, sir.

    47   MR. JUSTICE BELL:  Yes.  Thank you.

    49   MR. MORRIS:  You said he made this allegation about working very
    50        long hours when he left, and do you remember checking the 
    51        schedule?

    53   MR. JUSTICE BELL:  No, that is not right, because "this
    54        allegation" might be taken to refer to the 97 hours.

    56   MS. STEEL:   That is what it says.  It says that in the
    57        statement.

    60        it was made.
