Day 173 - 16 Oct 95 - Page 18

  Q. In the crew handbook, the pay increases are set out, which
you have also mentioned in your statement, as 0 to 12 pence
depending on their grading; and there are five different
grades. Do you know what percentage of crew usually get
what grade and, therefore, what rise?
       A. No.

  Q. You have no idea?
       A. No. I cannot recall.

  Q. Do you have anything to do with wage increases at all,
       performance related wage increases?
       A. In the restaurants?

  Q. Yes.
       A. No. That was the management's responsibility.

  Q. Has that always been the case?
       A. Yes.

  Q. The wage rates are set by the JLC. Do they set overtime
       rates as well?
       A. Yes, they do.

  Q. And is that one and a half times the normal rate?
       A. Yes.

  Q. So that would have been -- although they did not apply to
Dublin, that would have been standard practice across
       industry at that time?
       A. Yes, I would imagine so.

MR. MORRIS: Do you know the reasoning behind the payment of
overtime being a part of the national agreement?
       I mean -----
       A. I am not quite sure I understand your question.

MR. RAMPTON: My Lord, it is not surprising. He is not the
       Irish Government.

MR. MORRIS: You are part of the industry. That is why -----

MR. JUSTICE BELL: Why do you not put what you think it is?

MR. MORRIS: Is the payment of overtime, which would be -- one
and a half times would be the set agreement, presumably
minimum, paid because it is expected that would be the fair
thing to do, that if people worked more than 40 hours, they
       should be paid overtime?
       A. Yes, it is -- I think it is. The overtime clause
within the labour laws in the country, to my knowledge, is
there because obviously that is what, you know, the
government expect employers to do, after the normal working
       week.

MS. STEEL: You said in your statement on page 13 -- I do not
know whether you want to look at it or not. It is actually
bundle page 136, if you do.
       A. Just one moment. 146?
