Day 190 - 23 Nov 95 - Page 06

wrapped over the knuckles if we had tried a similar tactic
of leaving it until the last minute.

MR. RAMPTON: It is not a tactic. The reason I raise it now is
that I did not see Lynval's interviews, the transcription
of the interview, until yesterday afternoon.

MS. STEEL: But Mr. Rampton also wants to object to Mr. Ryan's
interview and the notes from the meeting with the
       solicitor.

MR. JUSTICE BELL: I am not going to consider any question of
costs at this stage. Some time in the next century when
this case is completed, I will deal with the question of
costs overall; and if people want to raise costs of
individual items in the case, they can argue them then.

The only question is whether it is worth asking Ms. Lamb,
if she is going to be in London anyway, whether she can
ring in later in the day to see if there is any prospect of
her being called wholly or in part today. (Pause)

MR. MORRIS: What we will do is, we will phone Ms. Lamb at
       lunchtime.

MR. JUSTICE BELL: What I suggest is, unless Ms. Lamb has to
leave the area completely, that you make some arrangement
where you can ring her at about one o'clock.

MR. MORRIS: She is going back to work. It is in London.

MR. JUSTICE BELL: Does she work in London?

  MR. MORRIS: Brixton.

MR. JUSTICE BELL: Ms. Lamb, can you be somewhere near a
telephone between about ten to one and ten past?

MISS LAMB: Yes. I can do my best. If I go back to work, we
have actually got quite a major event at the House of
Commons today, and if I go back to work I ought to go to
that, because I cannot be back to work and not there. But
       I can do my best.

MR. JUSTICE BELL: What I would like Ms. Lamb to do is leave a
phone number, which she may have already, where she can
either be contacted or you can contact someone who will
know where Ms. Lamb is, so that you can try and get in
       touch with her.

The next stage is, I would invite you to deploy your
argument. Is this an instance where you are content that
the Defendants should have a transcript of the argument?

MR. RAMPTON: Yes, my Lord, certainly. I have also -- I am
afraid it is not as beautifully prepared as it sometimes
is, because I did it in a frightful hurry -- but I have a
bundles of authorities which do have a handwritten index on
       them.
