Day 191 - 24 Nov 95 - Page 02

                                     Friday, 24th November, 1995

MR. JUSTICE BELL: If I could just go back to the matter
Ms. Steel mentioned about the ruling which I gave on
       20th July, on page 19, paragraph 5.

  MS. STEEL: 20th November.

MR. JUSTICE BELL: 20th November, yes. I still have 20th July
on this. The reason for that, by the way, is that
Mr. Glenn took the facing page -- computerised it -- from
an earlier judgment, and we did not appreciate it was
there. Page 19, paragraph 5, the first sentence in the
typescript read: "The words across McDonald's Arches were
designed merely to catch the eye and not to encourage
people to read the rest of the leaflet."

The "not" clearly should not be there, as Ms. Steel says.
In fact, the sentence does not make sense with the "not"
there. But, by the same token, I do not wish to take out
the paragraph: "I do not accept that the Arches or the
cartoon catch the eye only, without delivering a message."
That should stay in, because that is consistent with the
       matter which Ms. Steel raised.

Did you understand what I said about the form you
       have -----

  MS. STEEL: Yes.

MR. JUSTICE BELL: I am going to take the "not" out, but not
       remove the others.

MS. STEEL: I did actually look up where I said it in the
       transcript.

MR. JUSTICE BELL: I am convinced you were right in the comment
       you made.

MS. STEEL: OK. If we call Mr. Baker.

                         KEITH JOHN BAKER, sworn
                       Examined by the Defendants

MS. STEEL: If you could give your full name and your occupation
       to the court, please?
       A. Mr. Keith John Baker, steel erector.

  Q. I have to find your statement.

MR. JUSTICE BELL: Do you want to go to Mr. Baker's statement?

  MS. STEEL: Yes.

MR. JUSTICE BELL: Can you see a volume which has a pale blue
spine on it, Mr. Baker, and a "2" against a green
background, and if you turn to divider number 19, please.

MS. STEEL: Is your statement there?
       A. Yes, it is -- a bit grotty, but it is there.
