Day 240 - 24 Apr 96 - Page 09

argument at the end of the case.

So, if you just go through, I would like you to strike out
for your reading purposes on page 3 the first complete
paragraph and the second complete paragraph; on page 4
from, "Therefore, in my considered opinion" to the bottom.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: On page 5 from 6.6, "I have read the
       submission" down to the bottom.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: On page 6 from the top down to, "Mr. Massa to
Robin Hellier 1.5.1984" and on page 7, "In the light of the
above" to the end. Nothing is struck out of the second
       statement.

Before you call Mr. Secrett, can I hold up that which
I found in my section where Mr. Secrett is. It is a
longhand note which starts "We act on behalf of Mike Love".

MR. RAMPTON: I do not know what it is doing in there, my Lord,
       I am sorry..

MR. JUSTICE BELL: I will hand it back down. I think it was
       handed up with photocopies.

MR. MORRIS: Is it at all relevant to anything in this case
because, if so, I think we ought to see a copy.

  MR. JUSTICE BELL: No.

MR. RAMPTON: It is a Barlows' draft of a letter.

MR. JUSTICE BELL: It seems to me it is something particular to
the Defendants. It has not been disclosed any more than if
you, by accident, handed up your notes of the case, I would
just hand them back to you. What I have written at the
bottom is a 7 in a circle and then crossed it out because
I paginate each section and that is part of my pagination.

MR. MORRIS: Is it relevant to any matter?.

MR. JUSTICE BELL: No, it is not a disclosable document.

  MR. RAMPTON: No.

MS. STEEL: Is it something about this case though?

MR. JUSTICE BELL: It is not a disclosable document.

MS. STEEL: But if it is something about this case, and it is
something which you have now seen from them ----

MR. JUSTICE BELL: No, it does not relate to any issue in the
       case.

MR. MORRIS: Can I have a word with our witness?
