Day 263 - 14 Jun 96 - Page 04
But there we are, anyway.

MS. STEEL: I could get on with the argument now. There was one
thing I did want to raise, which is about
Professor Crawford. The situation is that we have finally
got this morning a draft statement which we have not even
had time to read. It is very detailed, and it refers to
some references which we have not got. Now, I presumed --
well, not only is it a problem for us because we have not
had a chance to read it, but I have also presumed that the
Plaintiffs probably would not be very happy about not
having a chance to speak to their witnesses about what
Professor Crawford was saying.

I asked Professor Crawford yesterday evening if there was
any other time he could attend, and he said that he is
available on the 25th and 26th. So, we were going to
suggest that he could be moved to those dates. I have
spoken to Jane Laporte, and she can basically do any time
apart from Tuesday afternoon; so she can be moved anyway.
I am fairly sure Mr. Gravett will be able to be moved.
Then we could finish off the publication witnesses,
Mr. Clare, and, if necessary, if that is not dealt with
this morning -- sorry, this afternoon -- Mr. Russell on the
Monday and the Tuesday.

I just thought I ought to bring that up at the beginning,
rather -----

MR. JUSTICE BELL: Do you have anything to say that about that?

MR. RAMPTON: No, I do not. I cannot say anything until I have
seen the report. But if there is a lot of detail and, in
particular, if there are scientific statements which I have
not seen and my witnesses have not seen, plainly I shall be
most unhappy to have to deal with Professor Crawford on
Monday. Provided the days are filled as best possible,
I am content, I do not mind which order the witnesses come
in, provided I have enough time to prepare.

The only thing I would say in the light of what Ms. Steel
has said is this. There are only four more meetings left
for Mr. Pocklington. Mr. Russell is now in London, having
come up from the country. It would be highly regrettable
if he were not heard today. Mr. Clare, anyway, I have
transferred to -- I am being realistic about that.

MR. JUSTICE BELL: Will we finish Mr. Russell today, if we start
him today?

MR. RAMPTON: He is only one meeting.

MR. JUSTICE BELL: How long do you think Mr. Russell will be?

MS. STEEL: I do not know, to be honest. I am not trying to
say we should not hear him today. I just thought that it
was likely he was not going to be finished today. The
other thing is, so far as I am aware, he actually works in
London. So, I am not quite sure -----
