     1   MR. RAMPTON:  Obviously, I will do everything in my power to do
     2        full cross-examination but, if I cannot, I cannot.

     4   MR. JUSTICE BELL:  We will see where we have got to.

     6   MR. RAMPTON:  It is not anybody's fault, but I was given the
     7        report yesterday and -----

     9   MR. JUSTICE BELL:   I understand that.  I am not making any
    10        comment one way or the other.

    12   MR. RAMPTON:  No, I am not either.  I also have another problem,
    13        but I hope this will be resolved as well, which is also
    14        connected with next week and it is this.  Though we should
    15        have done, we have not received the Defendants' Notice of
    16        Appeal, or their appeal bundle.  The bundle matters less.
    17        It is supposed to be served so soon as notice is given by
    18        the Court of Appeal that the hearing will be heard inter
    19        partes.  I took the liberty to speak to Mr. Nichol this
    20        morning.  He says it is best if I go by his skeleton
    21        argument, but unfortunately that will not be ready until
    22        Monday.

    24   MS. STEEL:  Can I just ask, was Mr. Rampton not sent a copy of
    25        the index and of the Notice of Appeal, because we did ask
    26        the solicitors to send them?

    28   MR. RAMPTON:  They have not done.  So Mrs. Brinley-Codd is
    29        trying to speak to the solicitor this morning so that she
    30        can get the Notice of Appeal and the index, but Mr. Nichol
    31        has told me that, when it comes to the argument, I should
    32        be better advised to focus on his skeleton argument.

    34   MR. JUSTICE BELL:  Yes.

    36   MR. RAMPTON:  What I do not know at the moment, because I have
    37        not seen it, is how substantial the work I shall have to
    38        do, because the Court of Appeal will expect me to do some
    39        as well and I not know how substantial it will be.

    41   MR. JUSTICE BELL:  What I suggest is that when we get to the end
    42        of today's proceedings, we will know where we are then.

    44   MR. RAMPTON:  Yes.

    46   MR. JUSTICE BELL:  And you can raise that matter with me again.

    48   MS. STEEL:  If I just say, I have actually got a spare copy of
    49        the index here and they obviously will have copies of all
    50        the documents that go in it because they were all referred 
    51        to in court.  I have probably got a copy of the Notice of 
    52        Appeal, but I do not think I have got a spare copy.

    54   MR. JUSTICE BELL:  See what you can do when we get to the midday
    55        adjournment about providing a copy of that, because I would
    56        guess what Mr. Rampton has in mind is that if he has got
    57        the papers very late, I do not know whether what you feel
    58        is you may need time in one way or another.
