Day 267 - 21 Jun 96 - Page 03
MR. RAMPTON: Obviously, I will do everything in my power to do
full cross-examination but, if I cannot, I cannot.

MR. JUSTICE BELL: We will see where we have got to.

MR. RAMPTON: It is not anybody's fault, but I was given the
report yesterday and -----

MR. JUSTICE BELL: I understand that. I am not making any
comment one way or the other.

MR. RAMPTON: No, I am not either. I also have another problem,
but I hope this will be resolved as well, which is also
connected with next week and it is this. Though we should
have done, we have not received the Defendants' Notice of
Appeal, or their appeal bundle. The bundle matters less.
It is supposed to be served so soon as notice is given by
the Court of Appeal that the hearing will be heard inter
partes. I took the liberty to speak to Mr. Nichol this
morning. He says it is best if I go by his skeleton
argument, but unfortunately that will not be ready until
Monday.

MS. STEEL: Can I just ask, was Mr. Rampton not sent a copy of
the index and of the Notice of Appeal, because we did ask
the solicitors to send them?

MR. RAMPTON: They have not done. So Mrs. Brinley-Codd is
trying to speak to the solicitor this morning so that she
can get the Notice of Appeal and the index, but Mr. Nichol
has told me that, when it comes to the argument, I should
be better advised to focus on his skeleton argument.

MR. JUSTICE BELL: Yes.

MR. RAMPTON: What I do not know at the moment, because I have
not seen it, is how substantial the work I shall have to
do, because the Court of Appeal will expect me to do some
as well and I not know how substantial it will be.

MR. JUSTICE BELL: What I suggest is that when we get to the end
of today's proceedings, we will know where we are then.

MR. RAMPTON: Yes.

MR. JUSTICE BELL: And you can raise that matter with me again.

MS. STEEL: If I just say, I have actually got a spare copy of
the index here and they obviously will have copies of all
the documents that go in it because they were all referred
to in court. I have probably got a copy of the Notice of
Appeal, but I do not think I have got a spare copy.

MR. JUSTICE BELL: See what you can do when we get to the midday
adjournment about providing a copy of that, because I would
guess what Mr. Rampton has in mind is that if he has got
the papers very late, I do not know whether what you feel
is you may need time in one way or another.

MR. RAMPTON: What I am worried about is this. I expect to have
