Day 291 - 31 Oct 96 - Page 13

       page 3, line 38 and also day 98, page 49, line 32.

On day 98, page 4, line 4, he said that it was mostly dairy
cows or ex-dairy cows that would be supplied to McKeys from
Midland Meat Packers, confirming what we had pleaded a
considerable length of time ago but which Mr. Rampton tried
to get struck out in the pretrial hearing; that a large
proportion of the meat used by McDonald's is from ex-dairy
cows, old dairy cows. He said on day 98, page 3, line 5,
that Midland Meat did not have any specifications to their
suppliers to do specifically with animal welfare. He said
they were working on it at that time. So, obviously, they
did not have them at the relevant time in 1989/1990.

He said there had been a move away from the use of ramps in
slaughter houses during the unloading procedure because the
animals did not like walking down them and it was better
for the animals not to have to walk down them. So that is
an acceptance that at that time, and certainly before that
time, the unloading procedure, as we have heard from other
witnesses in any event, would cause stress to the animals.
Mr. Chambers admitted that noise was a problem in the
slaughter house, and he said it could be loud in a
slaughter house. Obviously, that was something that was
criticised by Dr. Long when he gave evidence for us as
something which added to the stress of the cows. Did
I give the reference for that? The bit about it being
       noisy in the slaughter house?

MR. JUSTICE BELL: You can give it to me if you have got it,
but it is a point which I have in mind and about which
I would have thought there would be the least doubt.

MS. STEEL: Day 97, page 54, line 16.

MR. JUSTICE BELL: I would not have expected anything
different. Was it me who asked some question about as to
whether you could actually hear music being played?

MR. MORRIS: Radio One, or something.

MS. STEEL: I can't remember if it was that day or some other
       day, actually.

MS. STEEL: Mr. Chambers said that goads were used at Midland
Meat despite the fact that it was in McKeys specifications
that they should not be used. We said on day 97, page 57,
line 3 that the company used goads, and when he was asked
about the McKey audit form, which said for number 2 'use of
goads prohibited', he said that he had not seen that
specification before, he had not seen it on a McKey
specification. That was on day 97, page 77, starting at
       line 40.

He said on day 98, page 38, line 50, that the goads were
used on the cattle when they would not move. He did say
that he was asked about whether or not McKey had made
inspections of Midland Meat and he said "yes", and he said
he was asked about whether or not McKeys would have seen
Midland Meat using the goads on the cattle. He said, "We
