LICENSE AGREEMENT All information recorded on the disks / CD-ROM is denoted Software in the following. The Software is the property of Virtek International Corporation, 3 Christina Center , Wilmington, DE, USA. You are not allowed to reverse engineer, decompile or disassemble the Software. The Software is protected by US and international copyright laws, and all other international or national laws that may apply. Virtek International Corporation hereby grants you a non-exclusive license to use the Software as follows: You may use the Software on any computer, provided that the Software, or any part of the Software cannot possibly be used on any other computer or by any other person at the same time. This means that if a team is working on a project, where each person is using a part of the Software, each person must have a licensed copy of the Software or be covered by the Virtek site-license agreement. You may make copies of the Software for the sole purpose of loading it into the computer on which you wish to use it, or for keeping a maximum of two back-up copies.. You are furthermore granted the royalty free right to use, sell and otherwise distribute programs developed by you using the 3D-Ware Library provided as part of the Software. You are also allowed to use, sell and distribute the compiled 3D shape files (*.3D) supplied with the Software. All use and distribution are subject to the following terms and conditions: 1. Any parts of the Software you are allowed to distribute, as specified above, remain the property of Virtek. You are not allowed to transfer the above rights to incorporate any part the 3D-Ware Library and compiled shape files into a program to any other person or organisation. You are, however, allowed to let other persons or organisations resell a program you have developed in compliance with the terms and conditions of this agreement. 2. You are not allowed to supply any part of the 3D-Ware Library or compiled shape files in any form intended for use by another program. 3. You are not allowed to rent or lease out any part of the Software. 4. You must keep all source code, header files, definition files and interface files relating to the 3D-Ware Library in the strictest of confidence. 5. Your software documentation must contain the following notice clearly displayed: "Parts of this program, (C) Virtek International Corporation." 6. Your program must display the line: "3D graphics by Virtek International Corp." for a period of not less than 2 seconds. 7. If you sell or distribute more than 10,000 copies of a product containing any part of the 3D-Ware Library you must notify Virtek in writing immediately. Please note there will be no royalty to pay either before or after you reach the 10,000 copy limit. Virtek simply requires you to register your use of the software. This software product is owned by Virtek International Corporation, a Delaware Corporation. It is protected by US and international copyright laws, and all other international or national laws that may apply. LIMITED WARRANTY Virtek warrants that the 3D-Ware files are accurate copies of the software and will replace any mechanically defective copies free of charge for a period of 60 days after purchase. Virtek warrants that the software will perform substantially as described in the enclosed documentation for a period of 90 days. Virtek's entire liability and your only remedy shall be, either a refund of the price you paid, or that Virtek repairs any defects within 60 days. Virtek alone decides which of the above remedies shall be used. Virtek hereby disclaims all other warranties whether expressed or implied, including, without limitation, any implied warranties of merchantability and fitness for any particular purpose. Virtek shall have no liability for consequential, incidental, exemplary, special or any other kind of damages including lost profits. Virtek reserves the right to change the software and documentation at any time, without prior notice.
