Because things like the filesystem and scsi.device have already been
loaded from ROM and are still in use, making it impossible to flush
them.

Unless you can think of a way of running SetPatch from a cold boot
without enabling the hard drive? :)

The problem is the size of the market. There wouldn't be enough sales to
justify making 3.9 ROMs. That's why the AmigaONE's flash ROM is such a
good idea.
