They only fail to work when you disagree with them :)

It is if they replace the fuel used and bring the car back after using
it. There is absolutely no difference between borrowing it and stealing
it in that case, except your permission wasn't asked. That is the key
point, it belongs to someone and you don't take it without their
permission.

That's not their job. A software author's task is to write software, not
police the Internet. Your argument is like saying it's not the crime
that's wrong, but getting caught.

Of course it's often true that the software has been abandoned, but you
can't assume that and it won't help you if you get sued.
