  1. M-B-A-NALYST FINANCIAL CALCULATOR
  2. SOFTWARE LICENSE AGREEMENT - SHAREWARE EDITION

  4. BY USING THIS SOFTWARE, YOU AGREE TO THE
  5. FOLLOWING TERMS AND CONDITIONS:

  7. 1. You are granted a license to use M-B-A-nalyst for a period of
  8. up to 60 days. After that time, you are required to purchase the
  9. product(s) through registration or else discontinue their use.
  10.  
  11. 2. You are allowed to make copies of this diskette and distribute
  12. them to your friends and co-workers, on electronic bulletin
  13. boards, and so on, as long as the product is not distributed for
  14. profit (handling fees up to $5.00 ok). If you distribute this
  15. software, you agree to distribute all the associated files on
  16. this diskette together as a group.  You are not allowed to bundle
  17. this software with other products without prior written
  18. permission from CalcTech.

  20. 3. You are not allowed to make any modifications to, or to create
  21. derivative works from any of the files that are used in this
  22. software. This includes all the executable, help, installation,
  23. and readme files, as well as graphics images.

  25. 4. THE SOFTWARE HEREIN ARE PROVIDED "AS IS"
  26. WITHOUT WARRANTY OF ANY KIND, EITHER
  27. EXPRESSED OR IMPLIED, BUT NOT LIMITED TO, THE
  28. IMPLIED WARRANTIES OF MERCHANTABILITY AND
  29. FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE
  30. RISK AS TO THE QUALITY AND PERFORMANCE OF THE
  31. PROGRAMS IS WITH YOU. SHOULD THE PROGRAMS
  32. PROVE DEFECTIVE, YOU (AND NOT CALCTECH, INC.
  33. OR AN AUTHORIZED CALCTECH DEALER) ASSUME THE
  34. ENTIRE COST OF ALL NECESSARY SERVICING,
  35. REPAIR, OR CORRECTION.

  37. SOME STATES DO NOT ALLOW THE EXCLUSION OF
  38. IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION
  39. MAY NOT APPLY TO YOU. THIS WARRANTY GIVES
  40. YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO
  41. HAVE OTHER RIGHTS WHICH VARY FROM STATE TO
  42. STATE.

  44. 5. IN NO EVENT SHALL CALCTECH OR ANY OF IT'S
  45. AUTHORIZED DEALERS OR SUPPLIERS BE LIABLE TO
  46. YOU OR ANY OTHER PARTY FOR ANY DAMAGES
  47. WHATSOEVER (INCLUDING, WITHOUT LIMITATION,
  48. DAMAGES FOR LOSS OF BUSINESS PROFITS,
  49. BUSINESS INTERRUPTION, LOSS OF BUSINESS
  50. INFORMATION, OR OTHER PECUNIARY LOSS) ARISING
  51. OUT OF THE USE OF OR INABILITY TO USE THIS
  52. SOFTWARE, EVEN IF CALCTECH HAS BEEN ADVISED
  53. OF THE POSSIBILITY OF SUCH DAMAGES.

  55. SOME STATES DO NOT ALLOW THE LIMITATION OR
  56. EXCLUSION OF LIABILITY FOR INCIDENTAL OR
  57. CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION
  58. OR EXCLUSION MAY NOT APPLY TO YOU.
