  21. The shareware evaluation (trial use) version is provided AS IS.  Green
  22. Diamond Software MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED,
  23. INCLUDING WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY AND/OR
  24. FITNESS FOR A PARTICULAR PURPOSE.

  31. Green Diamond Software warrants the physical diskette(s) and physical
  32. documentation provided with registered versions to be free of defects in
  33. materials and workmanship for a period of ninety (90) days from the date
  34. of registration.  If Green Diamond Software receives notification within
  35. the warranty period of defects in materials or workmanship, and such
  36. notification is determined by Green Diamond Software to be correct, Green
  37. Diamond Software will replace the defective diskette(s) or documentation.

  39. The entire and exclusive liability and remedy for breach of this Limited
  40. Warranty shall be limited to replacement of defective diskette(s) or
  41. documentation and shall not include or extend to any claim for or right
  42. to recover any other damages, including but not limited to, loss of
  43. profit, data, or use of the software, or special, incidental, or
  44. consequential damages or other similar claims, even if Green Diamond
  45. Software has been specifically advised of the possibility of such
  46. damages.  In no event will Green Diamond Software's liability for any
  47. damages to you or any other person ever exceed the lower of suggested
  48. list price or actual price paid for the license to use the software,
  49. regardless of any form of the claim.
