TITLE PC SOFTWARE ADDITIONAL LICENSE OPTION AVAILABLE THROUGH IBM
AUTHORIZED REMARKETERS
ABSTRACT Effective today, the Additional License option, which permits
customers to make authorized copies of eligible licensed programs,
licensed program upgrades, and documentation, is available through
IBM Authorized Remarketers. Additional Licenses continue to be
available through M&S Market Operations. Furthermore, Additional
Licenses acquired through IBM Authorized Remarketers may aggregate
toward fulfillment of a qualifying Volume Procurement Amendment (VPA)
or special bid through participation in the IBM Customer Fulfillment
Option (CFO) program for IBM Personal Computer/System Programs.
OVERVIEW DESCRIPTION
Additional Licenses and Additional License upgrades are available
from IBM for eligible licensed programs with a separate single unit
one-time charge. Each Additional License must be ordered by the
customer from IBM directly or through an IBM Authorized Remarketer.
The customer must have acquired at least one Program Package and
accepted the terms and conditions of the IBM Program License
Agreement (PLA) prior to ordering Additional Licenses of the licensed
program. Among the valid Proofs of License for Program Package
acquisition are an IBM invoice or IBM Authorized Remarketer invoice
with product detail, the original cover page of the Program Package
manual, or an original proof of license page inserted into the
Program Package container.
A Program Package includes the media on which the
machine-readable program materials are recorded, documentation, and
other associated materials. Nothing will be physically shipped to
the customer who has ordered an Additional License. Instead, the
customer has the right to make copies of the original Program Package
upon receipt of an authorization issued by IBM that identifies the
Program Package and the quantity authorized. This authorization also
includes the right to make a copy of the Program Package
documentation for each authorized Additional License or Additional
License upgrade. All Additional License copies, and all authorized
copies made from them, must not be transferred to any third party.
The authorized Additional License copy may be a copy
downloaded to a machine, recorded on portable media, or made by any
other electronic means. Additional License copies may be made only
1) by the customer, or 2) on behalf of the customer by other persons
during the period such other persons are on the customer's or
remarketer's premises. The customer ordering an Additional License
through an IBM Authorized Remarketer will sign an End User Agreement
for Additional Licenses. When countersigned by an NDD branch manager
or administration manager and returned to the customer, the End User
Agreement for Additional Licenses serves as the customer's
authorization to copy. This validated form also serves as the
customer's proof of license.
ADDITIONAL LICENSE UPGRADES
If IBM announces an upgrade to a new version of a program, a customer
may wish to order Additional License upgrades. The Additional
License upgrade is available whether the original license was
acquired as a Program Package or as an Additional License. In either
case, the total quantity of Additional License upgrades acquired for
a specific product may not exceed the total quantity of licenses (the
number of licenses that came with Program Packages and the number of
authorized Additional Licenses) previously acquired for the program.
If the original Additional Licenses were acquired through an IBM
Authorized Remarketer, the original copy of the End User Agreement
for Additional Licenses signed by IBM shall constitute the required
proof of license of the original acquisition. If the original
Additional Licenses were acquired from IBM directly, the Proof of
License for upgrade eligibility is a copy of the IBM invoice. When
ordering Additional License upgrades, the customer must also have
ordered at least one Program Package upgrade, either previously or at
the same time the Additional License is ordered. Proof of License of
the Program Package upgrade remains as described in the first
paragraph of this description for any Program Package.
