  1. IMPORTANT - READ CAREFULLY

  3. This license statement and limited warranty constitutes a legal agreement 
  4. ("License Agreement") between you ("Licensee", as an individual) and 
  5. Imaging Luminary LLC., ("Vendor"), for the software product 
  6. Essential HDR ("Software") of which Imaging Luminary LLC. is the copyright holder.

  9. The Web Site referred to in this agreement is http://www.imagingluminary.com.

  11. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND 
  12. BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.

  14. Upon your acceptance of the terms and conditions of the License Agreement, 
  15. Imaging Luminary LLC. grants you the right to use the Software in the manner 
  16. provided below.

  18. If you do not accept the terms and conditions of the License Agreement, 
  19. you are to promptly delete each and any copy of the Software from your computer(s). 
  20.  
  21. This license agreement only applies to the software product "Essential HDR". 
  22. The Vendor reserves the right to license the same Software to other individuals 
  23. or entities under a different license agreement.

  25. After accepting this license agreement, the Licensee must contact the Vendor to 
  26. obtain a license for commercial use of the product.

  30. Grant of License
  31.  
  32. A single license grants the licensee the option of installing the Software on up to
  33. three computers used exclusively by a single person. Installing the Software on a network 
  34. server, is not permitted. 
  35.  
  36. A multi-user license grants the Licensee the option to install the Software 
  37. on as many machines as licenses were bought, but no more, or the Licensee 
  38. may choose to install the Software on one or more network servers on the 
  39. condition that the number of client machines that have access to that server 
  40. or those servers, is equal to or less than the number of licenses bought. 
  41. When the number of client machines grows, the Licensee must buy additional licenses.

  44. Technical Support
  45.  
  46. Technical support is available directly from the Vendor at no additional 
  47. charge. When encountering problems, the Licensee must first read the documentation 
  48. included with the Software and then visit the Web Site and read the information 
  49. presented there to make sure the question or problem is not already answered there. 
  50. If not, the licensee may write to technical support email address with the question.

  53. Limited Warranty
  54.  
  55. The Software is provided "as is". In no event shall the Vendor or any of his 
  56. affiliates be liable for any consequential, special, incidental or indirect 
  57. damages of any kind arising out of the delivery, performance or use of this 
  58. Software, to the maximum extent permitted by applicable law. While the Software 
  59. has been developed with great care, it is not possible to warrant that the 
  60. Software is error free. The Software is not designed or intended to be used in 
  61. any activity that may cause personal injury, death or any other severe damage or loss.

  64. Ownership, Copyright and distribution
  65.  
  66. The Software remains the exclusive property of the Vendor. Any Licensee who 
  67. fully complies with the terms in this license agreement may use it according 
  68. to the terms of this license agreement.

  70. You may distribute the Software that is available for public download on the 
  71. Web Site at the moment that you do distribute it, on the condition that you 
  72. do this by making identical copies of the downloaded file(s). Public download 
  73. means any file that can be downloaded by browsing to the Web Site and navigating 
  74. through the links visible on the page, without the use of any password or 
  75. identification that you may type in or that may be automatically supplied 
  76. by your browser if you have typed it in before.

  78. You must not ask payment for the act of distributing the evaluation version 
  79. of the Software or for the evaluation version itself. You may ask a reasonable 
  80. contribution to cover your expenses in material, shipping and communication costs. 
  81. You must make it clear to the recipient that you are sending an evaluation 
  82. version and that the recipient will have to accept a license agreement in order 
  83. to evaluate it, and make payment in order to fully use the Software. You must 
  84. not distribute the evaluation version by making it part of a larger package, 
  85. unless that package is a collection of evaluation software and other software 
  86. that does not require payment.

  88. Miscellaneous.

  90. You must not attempt to reverse compile, modify, translate or disassemble the 
  91. Software in whole or in part. You must not run the Software under a debugger or 
  92. similar tool allowing you to inspect the inner workings of the Software.

  94. The Vendor reserves the right to revoke your license if you violate any or all 
  95. of the terms of this license agreement, without prior notice.
