You are being provided a copy of a new Beta version of Shadow Watch for your review and personal use prior to its general availability. By clicking on the Accept button below and installing Shadow Watch software, you are agreeing to the following terms and conditions. If you do not agree to the following terms and conditions, you are not authorized to use the software, and you should return the CD-ROM and documentation to Red Storm.
1. You agree that Shadow Watch is the sole property of Red Storm and includes valuable copyrights and trade secrets of Red Storm. You agree to treat Shadow Watch as confidential and WILL NOT without the express written authorization of Red Storm:
(a) copy Shadow Watch except for use on a single computer for your use only; or
(b) distribute Shadow Watch or transfer rights under this license to any third party; or
(c) publish or otherwise disclose information relating to performance of the Shadow Watch to any third party; or
(d) modify, reuse, disassemble, decompile, reverse engineer or otherwise translate Shadow Watch or any portion thereof.
VIOLATION OF THIS LICENSE CONSTITUTES UNAUTHORIZED USE OF SHADOW WATCH AND VIOLATION OF UNITED STATES AND INTERNATIONAL COPYRIGHT LAWS AND TREATIES. PIRACY OF SOFTWARE IS ILLEGAL AND RED STORM WILL PURSUE ALL LEGAL REMEDIES IN LAW OR EQUITY TO PROTECT ITS RIGHTS.
2. In consideration for receiving a beta copy of Shadow Watch, You agree to notify Red Storm of all problems and ideas for enhancements which come to Your attention. You grant to Red Storm a non-exclusive, non-transferable, fully paid-up, royalty-free, perpetual license to use modify, copy, sublicense and distribute such enhancements and all property rights therein including without limitation license rights to use all patent, copyright, trade secret, mask work, trademark, moral right or other intellectual property rights embodied in such enhancements.
3. You acknowledge that Shadow Watch is a pre-release version, does not represent the final product, and may contain bugs, errors or other problems that could cause the product to fail. Consequently, You agree that Shadow Watch is provided "AS IS", and acknowledge that RED STORM MAKES NO EXPRESS, IMPLIED, OR STATUTORY WARRANTY OF PERFORMANCE, MERCHANTABILITY, OR FITNESS OF PURPOSE. RED STORM SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR DAMAGES, INCLUDING LOST PROFITS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
4. The terms of this License shall be governed, construed and enforced in accordance with the laws of the United States of America and of the State of North Carolina.
