  1. T-SHIRT MAKER SOFTWARE LICENSE AGREEMENT

  3. 1. Grant of License
  4.  
  5. This T-shirt Maker license agreement grants you a non-
  6. exclusive right to load and use the T-shirt Maker Software 
  7. Freeware Version 1.0x (the "Software"), subject to the 
  8. restrictions below.
  9.  
  10. The Software is "loaded" onto a computer when it is either 
  11. copied to the permanent memory of the computer (for example, 
  12. the hard disk) or loaded into the temporary memory (RAM), 
  13. such as when a computer runs the software from a network 
  14. server, or a floppy disk.
  15.  
  16. 2. Copyright
  17.  
  18. The Software is owned by Austin-James, Inc. and is protected 
  19. by United States copyright laws and international treaty 
  20. provisions. You must treat the software like any other 
  21. copyrighted material ( for example, a book), except that you 
  22. may make a copy for the purposes of loading it onto the hard 
  23. disk of the computers that are licensed under this 
  24. agreement.

  26. 3. Other Restrictions
  27.  
  28. You may not transfer your rights under this agreement. You 
  29. must not rent or lease this software. You may not decompile 
  30. or disassemble the Software. You may not distribute the 
  31. Software as part of any of any other software, or collection 
  32. of software without the agreement of Austin-James Inc.

  34. 4. Distribution
  35.  
  36. The Freeware version of T-shirt Maker may distributed only 
  37. under the terms and conditions of the Distribution License 
  38. (shown below).

  41. LIMITED WARRANTY AND DISCLAIMER OF WARRANTY

  43. THIS SOFTWARE AND ACCOMPANYING WRITTEN MATERIALS (INCLUDING 
  44. INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY 
  45. OF ANY KIND. FURTHER, AUSTIN-JAMES, INC. DOES NOT WARRANT, 
  46. GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR 
  47. THE RESULTS OF USE, OF THE SOFTWARE OR WRITTEN MATERIALS IN 
  48. TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR 
  49. OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE 
  50. OF THE SOFTWARE IS ASSUMED BY YOU. IF THE SOFTWARE OR 
  51. WRITTEN MATERIALS ARE DEFECTIVE YOU, AND NOT AUSTIN-JAMES 
  52. INC. OR ITS DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYEES, 
  53. ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, 
  54. OR CORRECTION.

  56. THE ABOVE IS THE ONLY WARRANTY OF ANY KIND, EITHER EXPRESS 
  57. OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED 
  58. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR 
  59. PURPOSE, THAT IS MADE BY AUSTIN-JAMES INC., ON THIS AUSTIN-
  60. JAMES INC. PRODUCT. NO ORAL OR WRITTEN INFORMATION OR ADVICE 
  61. GIVEN BY AUSTIN-JAMES INC., ITS DEALERS, DISTRIBUTORS, 
  62. AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY 
  63. INCREASE THE SCOPE OF THIS WARRANTY AND YOU MAY NOT RELY ON 
  64. ANY SUCH INFORMATION OR ADVICE. YOU MAY HAVE OTHER RIGHTS 
  65. WHICH VARY FROM STATE TO STATE.

  67. NEITHER AUSTIN-JAMES INC. NOR ANYONE ELSE WHO HAS BEEN 
  68. INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THIS 
  69. PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, 
  70. CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR 
  71. LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF 
  72. BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE 
  73. OR INABILITY TO USE SUCH PRODUCT EVEN IF AUSTIN-JAMES INC. 
  74. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  77. T-SHIRT MAKER FREEWARE VERSION DISTRIBUTOR LICENSE
  78.  
  79. A license to distribute copies of T-shirt Maker Freeware 
  80. Version ("The Software") is granted by Austin-James, Inc. 
  81. subject to the following terms and conditions:

  83. 1. The Software remains the sole, exclusive, proprietary and 
  84. confidential property of AUSTIN-JAMES Inc.
  85.  
  86. 2. Copies of The Software distributed must include all files 
  87. listed under FILES TO BE DISTRIBUTED below.
  88.  
  89. 3. Copies of The Software distributed must be identified as 
  90. Freeware, and must be accompanied by a suitable definition 
  91. of Freeware.
  92.  
  93. 4. The Software may not be modified in any way.
  94.  
  95. 5. This license may be terminated by Austin-James, Inc. at 
  96. any time. For copies of the Software distributed by BBS's or 
  97. on disks with no other programs, distribution of the 
  98. Software will be stopped immediately following such a 
  99. termination. For copies distributed as part of a collection 
  100. of shareware, no new masters of a collection will be made 
  101. that contain The Software immediately following such a 
  102. termination.
