  3. Please read this license carefully before using the software. 
  4. By using the software, you are agreeing to be bound by the terms 
  5. of this license. If you do not agree to the terms of this license, 
  6. promptly return the unused software to the place where you 
  7. obtained it and your money will be refunded.

  9. 1. License. The application and other software ("the Software") 
  10. accompanying this license is licensed to you by Motivision. 
  11. Motivision retains title to the Software. 
  12.  
  13. This license allows a single user to:
  14.     (a) Use the software on one computer at a time.
  15.     (b) Make one copy of the Software in machine readable 
  16.         form solely for backup purposes. The software is 
  17.         protected by copyright laws. As an express condition 
  18.         of this License, you must reproduce on each copy the 
  19.         Motivision copyright notice and any other proprietary 
  20.         legends that were on the original copy supplied by Motivision.

  23. 2. Restrictions. You may NOT distribute copies of the Software to 
  24. others or electronically transfer the Software from one computer 
  25. to another over a network or otherwise. The Software contains 
  26. copyrighted material, trade secrets, and other proprietary information. 
  27. In order to protect them you may not reverse engineer, disassemble, 
  28. decompile, or reduce the Software or its direct products to any human 
  29. readable form. You may not MODIFY, ADAPT, TRANSLATE, RENT, LEASE, LOAN, 
  30. RESELL, DISTRIBUTE or NETWORK the Software in whole or in part, nor may 
  31. you provide the use of the software, nor advertise the use of the 
  32. software, as a service to others.

  34. 3.) Export law assurances. You agree and certify that neither the Software 
  35. nor any direct product thereof will be exported from the United States 
  36. except as permitted by the laws and regulations of the United States.

  38. 4.) Indemnification. You agree to indemnify Motivision against all
  39. claims, liabilities and costs, including reasonable attorney fees,
  40. of defending any third party claim or suit involving the content of
  41. the screen savers you make or cause to be made using the Software.
  42. Motivision shall promptly notify you in writing of such claim or suit.
  43. You acknowledge full legal and moral responsibility for the content
  44. of any screen savers you make with the Software, and take full
  45. responsibility to ensure your content's compliance with applicable
  46. copyright, obscenity, and other statutes.

  48. 5.) Disclaimer of Warranty on Software and its Direct Products. You 
  49. expressly acknowledge and agree that use of the Software is at your 
  50. sole risk. The Software is provided "AS IS" and without warranty of 
  51. any kind. Motivision expressly disclaims all warranties, express or 
  52. implied, including but not limited to, the implied warranties of 
  53. merchantability and fitness for a particular purpose. Motivision 
  54. does not warrant that the functions contained in the Software will 
  55. meet your requirements, or that your operation of the software will 
  56. be uninterrupted or error free, or that defects in the software will 
  57. be corrected. Furthermore, Motivision does not warrant or make any 
  58. representation regarding the use or the result of the use of the 
  59. software in terms of their correctness, accuracy, reliability, or 
  60. otherwise. No oral or written information or advice given by Motivision 
  61. shall create a warranty or in any way increase the scope of this warranty. 
  62. Should the Software prove defective, you (and not Motivision) assume 
  63. the entire cost of all necessary servicing, repair, or correction. 
  64. Some states do not allow the exclusion of implied warranties, so the 
  65. above exclusion may not apply to you.

  67. Under no circumstances, including negligence, shall Motivision be 
  68. liable for any incidental, special, or consequential damages that 
  69. result from the use or inability to use the Software, even if 
  70. Motivision has been advised of the possibility of such damages. 
  71. Some states do not allow the limitation or exclusion of liability 
  72. for incidental or consequential damages, so the above limitation or 
  73. exclusion may not apply to you. In no event shall Motivision's total 
  74. liability to you for all damages, losses, and causes of action, whether 
  75. in contract, tort (including negligence) or otherwise exceed the 
  76. amount paid by you for the Software.

  78. 6.) Controlling Law and Severability. This License shall be governed 
  79. by and in accordance with the laws of the United States and the State 
  80. of California. If any part of this agreement is deemed invalid or 
  81. unenforceable, the remainder shall continue in full force and effect.

  83. 7.) Entire agreement. This license is the entire agreement between 
  84. you and Motivision concerning the use of the Software. No amendment 
  85. or modification to this agreement will be binding unless signed in 
  86. writing by a representative of Motivision.
