  6.   A. Grant of Licence
  7.   SILK WEBWARE ltd grants to Licensee a non-exclusive license to use 
  8.   afMailMe V 3.0 "Remindme V 3.0" (henceforth called the "Software") on a single web site
  9.   that is accessible over the Internet network or over an intranet 
  10.   network, as an "unregistered version" for a 30 day evaluation period. The
  11.   Software is copyrighted and title to all copies is retained by  SILK WEBWARE 
  12.    and/or it's licensors.  No right, title or  interest in and to any trademarks or 
  13.    trade names of  SILK WEBWARE, or  SILK WEBWARE's licensors is granted hereunder.

  15.   You are not permitted to distribute the applet in any fashion 
  16.   which would promote, encourage or allow reuse or redistribution 
  17.   of the Applet, other than as permitted above.

  19.   B. Warranty.
  20.   This Software and the accompanying files are provided "AS IS," 
  21.   without a warranty of any kind.

  23.   C.DISLAIMER OF WARRANTY 
  24.   THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND 
  25.   WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY 
  26.   OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the 
  27.   various hardware and software environments into which SILK WEBWARE's 
  28.   Software may be put, NO WARRANTY OF FITNESS 
  29.   FOR A PARTICULAR PURPOSE IS OFFERED.

  32.   D. Limitation of Liability.
  33.   IN NO EVENT WILL SILK WEBWARE OR ITS SUPPLIERS BE LIABLE FOR ANY 
  34.   LOST REVENUE, PROFIT OR DATA, OR FOR DIRECT, SPECIAL, INDIRECT, 
  35.   CONSEQUENTIAL, INCIDENTAL OR PUNATIVE DAMAGES HOWEVER CAUSED AND 
  36.   REGARDLESS OF THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR 
  37.   INABILITY TO USE SOFTWARE, EVEN IF SILK WEBWARE HAS BEEN 
  38.   ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  40.   E. Termination. 
  41.   This License is effective until terminated. Licensee may 
  42.   terminate the License at any time by destroying all copies of 
  43.   Software. The License will terminate immediately without notice 
  44.   from Silk Webware if Licensee fails to comply with any 
  45.   provision of this License. Upon termination, Licensee must 
  46.   destroy all copies of the software.

  48.   F. CONFIDENTIALITY.  Software is confidential and proprietary 
  49.   information of SILK WEBWARE, and/or it licensors. Licensee 
  50.   agrees to take reasonable steps to protect Software from 
  51.   unauthorized disclosure or use. Licensee shall not (and shall 
  52.   not permit other persons or entities to) reverse-engineer, 
  53.   decompile, disassemble, merge, modify, create derivative works 
  54.   of, or translate any part of the Software except as allowed in 
  55.   this license agreement.

  57.   G. Export Regulations. 
  58.   Software, including technical data, is subject to U.S. export 
  59.   control laws, including the U.S. Export Administration Act and 
  60.   its associated regulations, and may be subject to export or 
  61.   import regulations in other countries. Licensee agrees to comply 
  62.   strictly with all such regulations and acknowledges that it has 
  63.   the responsibility to obtain licenses to export, re-export, or 
  64.   import Software.

  66.   H. High Risk Activities. 
  67.   The Software is not fault-tolerant and  is not designed, 
  68.   manufactured or intended for use or resale as on-line control
  69.   equipment in hazardous environments requiring fail-safe 
  70.   performance, such as in the operations of nuclear facilities,
  71.   aircraft navigation or communication systems, or air traffic
  72.   control, in which the failure of the Software could lead 
  73.   directly to death, personal injury, or severe physical or 
  74.   environmental damage("High risk Activities"). SILK WEBWARE 
  75.   specifically disclaims any express or implied warranty of 
  76.   fitness for High Risk Activities.

  78.   I. Governing Law.
  79.   This agreement is made under, shall be governed by and construed 
  80.   in accordance with the laws of NewZealand.
  81.  
  82.   J. Integration. This agreement is the entire agreement between 
  83.   Licensee and SILK WEBWARE relating to Software and: 
  84.   (i) supersedes all prior or contemporaneous oral or written 
  85.   communications, proposals and representations with respect to 
  86.   its subject matter; and (ii) prevails over any conflicting or 
  87.   additional terms of any quote, order, acknowledgment, or similar 
  88.   communication between the parties during the term of this 
  89.   Agreement. No modification to this Agreement will be binding, 
  90.   unless in writing and signed by a duly authorized representative 
  91.   of each party.
