  3. MARSHALLSOFT COMPUTING, INC.  DISCLAIMS ALL WARRANTIES RELATING TO THIS
  4. SOFTWARE, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY
  5. IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  6. PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY AND SPECIFICALLY
  7. DISCLAIMED. NEITHER MARSHALLSOFT COMPUTING, INC.  NOR ANYONE ELSE WHO HAS
  8. BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS SOFTWARE
  9. SHALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES
  10. ARISING OUT OF THE USE OR INABILITY TO USE SUCH SOFTWARE EVEN IF
  11. MARSHALLSOFT COMPUTING, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  12. DAMAGES OR CLAIMS. IN NO EVENT SHALL MARSHALLSOFT COMPUTING, INC.'S
  13. LIABILITY FOR ANY SUCH DAMAGES EVER EXCEED THE PRICE PAID FOR THE LICENSE
  14. TO USE THE SOFTWARE, REGARDLESS OF THE FORM OF THE CLAIM. THE PERSON
  15. USING THE SOFTWARE BEARS ALL RISK AS TO THE QUALITY AND PERFORMANCE OF
  16. THE SOFTWARE.

  18. Some states do not allow the exclusion of the limit of liability for
  19. consequential or incidental damages, so the above limitation may not
  20. apply to you.

  22. This agreement shall be governed by the laws of the State of Alabama and
  23. shall inure to the benefit of MarshallSoft Computing, Inc.  and any
  24. successors, administrators, heirs and assigns.  Any action or proceeding
  25. brought by either party against the other arising out of or related to
  26. this agreement shall be brought only in a STATE or FEDERAL COURT of
  27. competent jurisdiction located in Madison County, Alabama. The parties
  28. hereby consent to in personam jurisdiction of said courts.
