  1. IBM VIRTUAL WORLD LICENSE AGREEMENT

  5. PLEASE READ THIS LICENSE AGREEMENT CAREFULLY. YOU MUST
  6. AGREE TO AND ACCEPT THE FOLLOWING TERMS AND CONDITIONS
  7. BEFORE YOU INSTALL THE CLIENT WORLD, WHICH IS PART OF
  8. THE IBM VIRTUAL WORLD, ON YOUR COMPUTER.

  12. The IBM Virtual World is made available to IBM customers to
  13. introduce IBM products and technology. You may use the Client
  14. World to send messages, which are displayed in the IBM Virtual
  15. World, to other concurrent users. Messages should only contain
  16. content that is intended to be placed in the public domain and
  17. is not otherwise proprietary or confidential to any party.

  21. Messages displayed in the IBM Virtual World should meet
  22. reasonable standards of decency, and be free of any defamatory
  23. or offensive sexual, racial, ethnic, or otherwise objectionable
  24. connotations. Nevertheless, due to the open access to the
  25. IBM Virtual World, some messages that are displayed may be
  26. offensive or controversial. IBM HEREBY EXPRESSLY
  27. DISCLAIMS ANY AND ALL RESPONSIBILITY FOR ANY AND ALL
  28. MESSAGES DISPLAYED IN THE IBM VIRTUAL WORLD BY THOSE WHO
  29. ACCESS IT. YOU REMAIN SOLELY RESPONSIBLE AND PERSONALLY
  30. LIABLE FOR ANY AND ALL MESSAGES YOU SEND FOR DISPLAY IN
  31. THE IBM VIRTUAL WORLD. YOU AGREE TO INDEMNIFY AND HOLD
  32. HARMLESS IBM, ITS SUBSIDIARIES AND ITS SUPPLIERS FROM
  33. AND AGAINST ANY CLAIMS OR LIABILITIES ARISING OUT OF THE
  34. DISPLAY OF SUCH MESSAGES.

  38. IBM WILL NOT MONITOR THE MESSAGES USERS SEND FOR DISPLAY
  39. IN THE IBM VIRTUAL WORLD, AND IBM WILL NOT EXERCISE ANY
  40. SCREENING, EDITORIAL, OR OTHER CONTROL OVER THE MESSAGES
  41. DISPLAYED IN THE IBM VIRTUAL WORLD. IBM reserves the right to
  42. discontinue your access to the IBM Virtual World for any reason.

  46. All intellectual property rights in the IBM Virtual World are
  47. owned by International Business Machines Corporation (IBM),
  48. one of its subsidiaries, or an IBM supplier and is protected
  49. by copyright law and international copyright treaty. It is
  50. licensed, not sold. Client World and IBM Virtual World Copyright
  51. International Business Machines Corporation and Worlds, Inc.,
  52. 1995, 1996. All rights reserved.

  56. IBM grants you free of charge a non-exclusive, non-transferable
  57. temporary use license to install one (1) copy of the Client
  58. World for your use on one (1) computer and to access the IBM
  59. Virtual World. Upon expiration of the license, you agree to
  60. delete the installed copy of the Client World and return to IBM
  61. or destroy the media, if any, on which it was provided to you.
  62. IBM reserves the right to discontinue the IBM Virtual World for
  63. any reason at any time. You shall not copy, merge, modify,
  64. distribute, reverse assemble, reverse compile, or otherwise
  65. translate the Client World except as specifically permitted by
  66. law without the possibility of contractual waiver.

  70. IBM licenses the Client World and access to the IBM Virtual
  71. World to you on an "AS IS" basis, without warranty of any kind,
  72. express or implied. IBM HEREBY EXPRESSLY DISCLAIMS ALL
  73. WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING,
  74. BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS
  75. OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
  76. The entire risk arising from use or performance of the IBM
  77. Virtual World and Client World remains with you. IBM does not
  78. warrant that the Client World will operate on your computer,
  79. or that the operation of the Client World and IBM Virtual World
  80. will be without error or failure.

  84. IBM WILL NOT BE LIABLE FOR ANY DIRECT DAMAGES OR FOR ANY
  85. SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OR FOR ANY
  86. ECONOMIC CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS
  87. OR SAVINGS) RESULTING FROM YOUR USE OF THE CLIENT WORLD
  88. AND/OR THE IBM VIRTUAL WORLD, EVEN IF IBM, OR ITS
  89. DISTRIBUTOR, HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  90. DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION
  91. OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
  92. THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

  96. If you use the IBM Virtual World in the United States or Puerto
  97. Rico, this license is governed by the laws of the State of New
  98. York. If you use the IBM Virtual World in Canada, this license
  99. is governed by the laws of the Province of Ontario. Otherwise,
  100. this license is governed by the laws of the country in which you
  101. use the IBM Virtual World.

  105. BY CLICKING ON THE "Accept" BUTTON, YOU ARE CONSENTING
  106. TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS
  107. AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF
  108. THIS AGREEMENT, CLICK THE "Cancel" BUTTON AND THE
  109. INSTALLATION PROCESS WILL NOT CONTINUE.
