  1. CREATIVE MULTIMEDIA SOFTWARE LICENSE
  2.  
  3. PLEASE READ THIS LICENSE CAREFULLY BEFORE USING
  4. THE SOFTWARE.  BY USING THE SOFTWARE, YOU ARE
  5. AGREEING TO BE BOUND BY THE TERMS OF THIS
  6. LICENSE.  IF YOU DO NOT AGREE TO THE TERMS OF
  7. THIS LICENSE, PROMPTLY RETURN THE UNUSED
  8. SOFTWARE TO THE PLACE WHERE YOU OBTAINED IT AND
  9. YOUR MONEY WILL BE RETURNED.
  10.  
  11. 1. License.  The application, demonstration, system and
  12. other software accompanying this License, whether on disk,
  13. in read only memory, or on any other media (the "Software")
  14. and related documentation are licensed to you by Creative
  15. Multimedia.  You own the disk on which the Software is
  16. recorded but Creative Multimedia and/or Creative
  17. Multimedia's Licensers retain title to the Software and
  18. related documentation.  This License allows you to use the
  19. Software on a single computer.  You may also transfer all
  20. your license rights in the Software, the backup copy of the
  21. Software, the related documentation and a copy of this
  22. License to another party, provided the other party reads and
  23. agrees to accept the terms and conditions of this License.

  25. 2.  Restrictions.  The Software contains copyrighted
  26. material, trade secrets and other proprietary material and
  27. in order to protect them you may not decompile, reverse
  28. engineer, disassemble or otherwise reduce the Software to a
  29. human-perceivable form.  You may not modify, network, rent,
  30. lease, loan, distribute or create derivative works based
  31. upon the Software in whole or in part.  You may not
  32. electronically transmit the Software from one computer to
  33. another or over a network.
  34.  
  35. 3.  Termination.  This License is effective until
  36. terminated.  You may terminate this License at any time by
  37. destroying the Software and related documentation and all
  38. copies thereof.  This license will terminate immediately
  39. without notice from Creative Multimedia if you fail to
  40. comply with the provision of this License.  Upon termination
  41. you must destroy the Software and related documentation and
  42. all copies thereof.
  43.  
  44. 4.  Export Law Assurances.  You agree and certify that
  45. neither the Software, nor any other technical data received
  46. from Creative Multimedia, nor the direct product thereof,
  47. will be exported outside the United States except as
  48. authorized and as permitted by the laws and regulations of
  49. the United States.
  50.  
  51. 5.  Government End Users.  If you are acquiring the Software
  52. on behalf of any unit or agency of the United States
  53. Government, the following provisions apply.  The Government
  54. agrees: (I) if the Software is supplied to the Department of
  55. Defense (DoD), the Software is classified as "Commercial
  56. Computer Software" and the Government is acquiring only
  57. "restricted rights" in the Software and its documentation as
  58. that term is defined in Clause 252.237-7013(c)(I) of the
  59. DFARS; and (II) if the Software is supplied to any unit or
  60. agency of the United Sates Government other than DoD, the
  61. Government's rights in the Software and its documentation
  62. will be as defined in Clause 52.227-19(c)(2) of the FAR or,
  63. in the case of NASA, in Clause 18-52.227-86(d) of the NASA
  64. Supplement to the FAR.

  66. 6. Limited Warranty on Media.  Creative Multimedia warrants
  67. the disks on which the Software is recorded to be free from
  68. defects in materials and workmanship under normal use for a
  69. period of ninety (90) days from the date of purchase as
  70. evidenced by a copy of the receipt.  Creative Multimedia
  71. will have no responsibility to replace a disk damaged by
  72. accident, abuse or misrepresentation.  ANY IMPLIED
  73. WARRANTIES ON THE DISCS, INCLUDING THE IMPLIED WARRANTIES OF
  74. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE
  75. LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF
  76. DELIVERY.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND
  77. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION
  78. TO JURISDICTION.

  80. 7.  Disclaimer of Warranty on Software.  You expressly
  81. acknowledge and agree that use of the Software is at your
  82. sole risk.  The Software and related documentation are
  83. provided "AS IS" and without warranty of any kind and
  84. Creative Multimedia and Creative Multimedia's Licenser(s)
  85. (for the purposes of provisions 7 and 8, Creative Multimedia
  86. and Creative Multimedia's Licenser(s) shall be collectively
  87. referred to as "Creative Multimedia") EXPRESSLY DISCLAIM ALL
  88. WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED
  89. TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
  90. FOR A PARTICULAR PURPOSE.  CREATIVE MULTIMEDIA DOES NOT
  91. WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL
  92. MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE
  93. SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT
  94. DEFECTS IN THE SOFTWARE WILL BE CORRECTED.  FURTHERMORE,
  95. CREATIVE MULTIMEDIA DOES NOT WARRANT OR MAKE ANY
  96. REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE
  97. OF THE SOFTWARE OR RELATED DOCUMENTATION IN TERMS OF THEIR
  98. CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE.  NO ORAL OR
  99. WRITTEN INFORMATION OR ADVICE GIVEN BY CREATIVE MULTIMEDIA
  100. OR A CREATIVE MULTIMEDIA AUTHORIZED REPRESENTATIVE SHALL
  101. CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS
  102. WARRANTY.  SHOULD THE SOFTWARE BE DEFECTIVE, YOU (AND NOT
  103. CREATIVE MULTIMEDIA OR A CREATIVE MULTIMEDIA AUTHORIZED
  104. REPRESENTATIVE) ASSUME
  105. THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR
  106. CORRECTION.  SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION
  107. OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT
  108. APPLY TO YOU.
  109.  
  110. 8.  Limitations of Liability.  UNDER NO CIRCUMSTANCES
  111. INCLUDING NEGLIGENCE, SHALL CREATIVE MULTIMEDIA BE LIABLE
  112. FOR ANY
  113. INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES
  114. THAT RESULT FROM THE USE OR INABILITY TO USE
  115. THE SOFTWARE OR RELATED DOCUMENTATION, EVEN IF
  116. CREATIVE MULTIMEDIA OR A CREATIVE MULTIMEDIA
  117. AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF
  118. THE POSSIBILITY OF SUCH DAMAGES.  SOME
  119. JURISDICTIONS DO NOT
  120. ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR
  121. INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE
  122. LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU..
  123. In no event shall Creative Multimedia's total liability to
  124. you for all damages, losses and causes of action (whether in
  125. contract, tort (including negligence or otherwise)) exceed
  126. the amount paid by you for the Software.

  128. 9. Controlling Law and Severability.  This License shall be
  129. governed by and construed in accordance with the laws of the
  130. United States and the State of Oregon as applied to
  131. agreements entered into and to be performed entirely within
  132. Oregon and between Oregon residents.  If for any reason a
  133. court of competent jurisdiction finds any provision of this
  134. License, or portion thereof, to be unenforceable, that
  135. provision of the License shall be enforced to the maximum
  136. extent permissible so as to effect the intent of the parties
  137. and the remainder of this License shall continue in full
  138. force and effect.

  140. 10.  Complete Agreement.  This License constitutes the
  141. entire agreement between the parties with respect to the use
  142. of the Software and related documentation, and supersedes
  143. all prior or contemporaneous understandings or agreements,
  144. written or oral, regarding such subject matter.  No
  145. amendment to or modification of this License will be binding
  146. unless in writing and signed by a duly authorized
  147. representative of Creative Multimedia.

  149. Warranty Disclaimer:

  151. CREATIVE MULTIMEDIA'S LICENSER(S) MAKES NO WARRANTIES,
  152. EXPRESS OR IMPLIED, INCLUDING WITHOUT
  153. LIMITATION THE PARTICULAR PURPOSE,
  154. REGARDING THE SOFTWARE.  CREATIVE
  155. MULTIMEDIA'S LICENSER(S) DOES NOT WARRANT,
  156. GUARANTEE OR MAKE ANY REPRESENTATIONS
  157. REGARDING THE USE OR THE RESULTS OF THE USE
  158. OF THE SOFTWARE IN TERMS OF ITS
  159. CORRECTNESS OR OTHERWISE.  THE ENTIRE RISK AS TO
  160. THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS
  161. ASSUMED BY YOU.  THE EXCLUSION OF IMPLIED
  162. WARRANTIES IS NOT PERMITTED BY SOME
  163. JURISDICTIONS.  THE ABOVE EXCLUSION MAY NOT
  164. APPLY TO YOU.

  166. Creative Multimedia Limited Warranty
  167. August 1, 1994
  168.  
  169. Creative Multimedia warrants that Creative Multimedia's
  170. software and the media on which it is recorded will work
  171. substantially in accordance with Creative Multimedia's
  172. operating instructions, when used on equipment meeting
  173. Creative Multimedia's specifications.  Creative Multimedia
  174. gives this warranty to the first consumer owner only.  If
  175. you have problems within the first ninety (90) days after
  176. you buy it, return the software to us, postage prepaid, with
  177. your purchase receipt, to:

  184. and if we find it to be defective, we will replace it
  185. with one that works on equipment meeting our

  190. THIS REMEDY.  If you lose your card, let us know; we'll
  191. send you another.

  193. YOUR REMEDIES ARE LIMITED TO MAT DESCRIBED PREVIOUSLY.
  194. CREATIVE MULTIMEDIA WILL NOT BE RESPONSIBLE
  195. FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS
  196. OF DATA OR LOSS OF USE, OR ANY OTHER FORM OF
  197. DAMAGE, EXCEPT AS ENCOMPASSES IN THE
  198. REPLACEMENT REMEDY DESCRIBED ABOVE.  Some states
  199. do not allow
  200. the exclusion or limitation of incidental or consequential
  201. damages, so the above limitation or exclusion may not
  202. apply to you.

  204. This warranty gives you specific legal rights and you may
  205. also have other rights which vary from state to state.

  209. IN NO EVENT WILL CREATIVE MULTIMEDIA'S LICENSER(S) AND
  210. THEIR DIRECTORS, OFFICERS, EMPLOYERS OR AGENTS
  211. (COLLECTIVELY CREATIVE MULTIMEDIA'S LICENSER(S)) BE LIABLE
  212. TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR INDIRECT
  213. DAMAGES (INCLUDING
  214. DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
  215. INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND
  216. THE LIKE) ARISING OUT OF THE USE OR INABILITY TO
  217. USE THE SOFTWARE EVEN IF CREATIVE
  218. MULTIMEDIA'S LICENSER HAS BEEN ADVISED OF THE POSSIBILITY
  219. OF SUCH DAMAGES.  BECAUSE SOME JURISDICTIONS DO NOT ALLOW
  220. THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL
  221. OR INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT
  222. APPLY TO YOU.  Creative Multimedia's Licensers' liability
  223. to you for actual damages from any cause whatsoever, and
  224. regardless of the form of action (whether in contract, tort
  225. (including negligence), product liability or otherwise),
  226. will be limited to $50.
