  4. LICENSE AGREEMENT
  5.  
  6. BEFORE YOU CLICK ON THE "AGREE" BUTTON AT THE END OF THIS 
  7. DOCUMENT, CAREFULLY READ THE TERMS AND CONDITIONS OF THIS 
  8. AGREEMENT. BY CLICKING ON THE "AGREE" BUTTON, YOU ARE 
  9. CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS 
  10. AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS 
  11. AGREEMENT, CLICK THE "DO NOT AGREE" BUTTON AND DO NOT USE
  12. THE PRODUCT.

  14. 1. Finjan Software Ltd. ("Finjan") grants to you a non-exclusive,
  15. non-sublicensable, license to use SurfinShieldXtra 2.0, in binary executable
  16. form (the "Product").
  17.  
  18. 2. GRANT OF LICENSE - This Finjan License Agreement ("License") permits
  19. you to use one copy of the Product acquired with this License on any
  20. single computer, provided the Product is in use on only one computer at
  21. any time. The Product is "in use" on a computer when it is loaded into
  22. the temporary memory (i.e. RAM) or installed into the permanent memory
  23. (e.g. hard disk, CD ROM, or other storage device) of that computer,
  24. except that a copy installed on a network server for the sole purpose of
  25. distribution to other computers is not "in use." If the anticipated
  26. number of users of the Product will exceed the number of applicable
  27. Licenses, then you must have a reasonable mechanism or process in place
  28. to assure that the number of persons using the Product concurrently does
  29. not exceed the number of Licenses.

  31. 3. COPYRIGHT - All title and copyrights in and to the Product and any
  32. copies thereof are owned by Finjan or its suppliers. All title and
  33. intellectual property rights in and to the content which may be accessed
  34. through use of the Product is the property of the respective content
  35. owner and may be protected by applicable copyright or other intellectual
  36. property laws and treaties. This agreement grants you no rights to use
  37. such content.

  39. The Product is owned by Finjan Software Ltd. and is protected by Israeli
  40. copyright laws, international treaty provisions and all other applicable
  41. national laws. Therefore, you must treat the Product like any other
  42. copyrighted material (e.g. a book or musical recording), except that if
  43. the Product is not copy protected, you may make one copy of the Product
  44. solely for backup or archival purposes, provided any copy must contain
  45. all of the original Product's proprietary notices. You may not copy the
  46. Product manual(s) or written materials accompanying the Product, if any.
  47. If you receive your first copy of the Product electronically, and a
  48. second copy on media, the second copy may be used for archival purposes
  49. only.

  51. All copies of the Product will contain the same proprietary notices
  52. which appear on and in the Product.

  54. 4. RESTRICTIONS - You may not rent or lease the Product, and may not
  55. transfer your rights under this License Agreement, without obtaining the
  56. prior written consent of Finjan. You may not reverse, engineer,
  57. decompile or disassemble the Product. You may not distribute copies of
  58. the Product to third parties. You may not integrate, incorporate or
  59. bundle the Product into any other Product or include such Product in
  60. other products or hardware without receiving the prior written consent
  61. of Finjan. You acknowledge that the Product in source code form remains
  62. a confidential trade secret of Finjan and/or its suppliers. You must
  63. maintain all copyright notices on all copies of the Product.

  65. 5. TERM - You may terminate your License and this Agreement at anytime
  66. by destroying all copies of the Product and Product documentation.
  67.  
  68. 6. TERMINATION - This license will terminate automatically if you fail
  69. to comply with any of the provisions contained herein. On termination,
  70. you must destroy all copies of the Product.
  71.  
  72. 7. MISCELLANEOUS - This Agreement represents the complete agreement
  73. concerning this License between the parties and supersedes all prior
  74. agreements and representations between them. It may be amended only by a
  75. writing executed by both parties. If any provision of this agreement is
  76. held to be unenforceable for any reason, such provision shall be
  77. reformed only to the extent necessary to make it enforceable.

  79. 8. NOTE ON JAVA SUPPORT - The Product contains support for programs
  80. written in Java. Java technology is not fault-tolerant and is not
  81. designed, manufactured, or intended for use or resale as on-line control
  82. equipment in hazardous environments requiring fail-safe performance,
  83. such as in the operation of nuclear facilities, aircraft navigation or
  84. communication systems, air traffic control, direct life support
  85. machines, or weapons systems, in which the failure of Java technology
  86. could lead directly to death, personal injury, or severe physical or
  87. environmental damage ("high risk activities"). Furthermore, the Product
  88. does not provide complete protection against harmful Java applications
  89. nor against Java Applets. THE USER IS EXPLICITLY WARNED THAT THE
  90. SECURITY ENHANCEMENT FEATURES OF THE PRODUCT DO NOT PROVIDE 
  91. TOTAL PROTECTION AGAINST DAMAGING JAVA ROUTINES.

  93. NO WARRANTY
  94.  
  95. NO WARRANTIES - THE PRODUCT IS PROVIDED "AS IS". FINJAN DOES 
  96. NOT WARRANT THAT THE PRODUCT IS ERROR-FREE. ADDITIONALLY, FINJAN 
  97. DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING 
  98. BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR 
  99. A PARTICULAR PURPOSE.

  101. NO LIABILITY FOR CONSEQUENTIAL DAMAGES - IN NO EVENT SHALL FINJAN 
  102. OR ITS SUPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL OR INDIRECT 
  103. DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR 
  104. LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS 
  105. INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF 
  106. OR INABILITY TO USE THE PRODUCT, EVEN IF FINJAN HAS BEEN ADVISED 
  107. OF THE POSSIBILITY OF SUCH DAMAGES.

  109. Some jurisdictions do not allow the exclusion of implied warranties or
  110. limitations on how long an implied warranty may last, or the exclusion
  111. or limitation of incidental or consequential damages, so the above
  112. limitations or exclusions may not apply to you. This license gives you
  113. specific legal rights, and you may also have other rights which vary
  114. from jurisdiction to jurisdiction.

  116. This Agreement is governed by the laws of the State of Israel. 
  117.
