  4. LICENSE AGREEMENT
  5.  
  6. BEFORE YOU CLICK ON THE "YES" BUTTON AT THE END OF THIS 
  7. DOCUMENT, CAREFULLY READ THE TERMS AND CONDITIONS OF THIS 
  8. AGREEMENT. BY CLICKING ON THE "YES" BUTTON, YOU ARE CONSENTING 
  9. TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU 
  10. DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, CLICK THE "NO" 
  11. BUTTON AND DO NOT USE THE SOFTWARE.

  13. 1.    Finjan grants to you a non-exclusive, non-sublicensable, 
  14. license to use SurfinCheck 1.0, in binary executable form for 
  15. evaluation and trial use purposes only for a period of 30 days.
  16.  
  17. 2.    GRANT OF LICENSE - This Finjan License Agreement ("License") 
  18. permits you to use one copy of SurfinCheck 1.0 ("SOFTWARE") 
  19. acquired with this License, which may serve as a server for up to 
  20. 10 computers (each, a "Seat").   A computer serves as a Seat when 
  21. it accesses or utilizes, directly or indirectly, the SOFTWARE.  
  22. Use of software or hardware which reduces the number of computers 
  23. directly accessing or utilizing the SOFTWARE (also know as 
  24. "pooling" or "multiplexing") will not reduce the number of Seats, 
  25. since each computer indirectly accessing or utilizing the 
  26. SOFTWARE is still considered a Seat.
  27.  
  28. 3.    COPYRIGHT - The SOFTWARE is owned by Finjan Software Ltd. or 
  29. its suppliers and is protected by Israeli copyright laws, 
  30. international treaty provisions and all other applicable national 
  31. laws.  Therefore, you must treat the SOFTWARE like any other 
  32. copyrighted material (e.g. a book or musical recording), except 
  33. that if the SOFTWARE is not copy protected, you may make one copy 
  34. of the SOFTWARE solely for backup or archival purposes, provided 
  35. any copy must contain all of the original SOFTWARE'S proprietary 
  36. notices.  You may not copy the Product manual(s) or written 
  37. materials accompanying the SOFTWARE.  If you receive your first 
  38. copy of the SOFTWARE electronically, and a second copy on media, 
  39. the second copy may be used for archival purposes only. The 
  40. license does not grant you any right to any enhancement or 
  41. update.

  43. 4.    RESTRICTIONS - You may not rent or lease the SOFTWARE, and 
  44. may not transfer your rights under this License Agreement, 
  45. without obtaining the prior written consent of Finjan.  You may 
  46. not reverse, engineer, decompile or disassemble the SOFTWARE.  
  47. You may not integrate, incorporate or bundle the SOFTWARE into 
  48. any other software or include such SOFTWARE in other software or 
  49. hardware without receiving the prior written consent of Finjan. 
  50. You acknowledge that the SOFTWARE in source code form remains a 
  51. confidential trade secret of Finjan and/or its suppliers.

  53. 5.    RELEASE - While Finjan intends to distribute a commercial 
  54. release of the Software, Finjan reserves the right at any time 
  55. not to release a commercial release of the Software or, if 
  56. released, to alter prices, features, specifications, 
  57. capabilities, functions, licensing terms, release dates, general 
  58. availability or other characteristics of the commercial release.
  59.  
  60. 6.    TERM - You may terminate your License and this Agreement at 
  61. anytime by destroying all copies of the Product and Product 
  62. documentation.

  64. 7.    TERMINATION - This license will terminate automatically upon 
  65. the earlier of (i) thirty days from the day you accept the terms 
  66. of this license as aforesaid, or (ii) upon your failure to comply 
  67. with the limitations described above. On termination, you must 
  68. destroy all copies of the SOFTWARE.

  70. 8.    NOTE ON JAVA SUPPORT - The product contains support for 
  71. programs written in Java.  Java technology is not fault tolerant 
  72. and is not designed, manufactured, or intended for use or resale 
  73. as on-line control equipment in hazardous environments requiring 
  74. fail-safe performance, such as in the operation of nuclear 
  75. facilities, aircraft navigation or communication systems, air 
  76. traffic control, direct life support machines, or weapons 
  77. systems, in which the failure of Java technology could lead 
  78. directly to death, personal injury, or severe physical or 
  79. environmental damage ("high risk activities").  Furthermore, the 
  80. product does not provide complete protection against harmful Java 
  81. applications nor against Java Applets.  THE USER IS EXPLICITLY 
  82. WARNED THAT THE SECURITY ENHANCEMENT FEATURES OF THE PRODUCT DO 
  83. NOT PROVIDE TOTAL PROTECTION AGAINST DAMAGING JAVA ROUTINES.

  85. 9.    MISCELLANEOUS - This Agreement represents the complete 
  86. agreement concerning this License between the parties and 
  87. supersedes all prior agreements and representations between them. 
  88. It may be amended only in writing, executed by both parties.  If 
  89. any provision of this agreement is held to be unenforceable for 
  90. any reason, such provision shall be reformed only to the extent 
  91. necessary to make it enforceable.

  93. NO WARRANTY
  94.  
  95. NO WARRANTIES - SOFTWARE IS PROVIDED "AS IS".  FINJAN DOES NOT 
  96. WARRANT THAT THE PRODUCT IS ERROR-FREE.  ADDITIONALLY, FINJAN 
  97. DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING 
  98. BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR 
  99. A PARTICULAR PURPOSE.
  100.  
  101. The SOFTWARE is being provided for purposes of a beta evaluation 
  102. by the user.  SOFTWARE IS PROVIDED IN AN EXPERIMENTAL, NON-FINAL 
  103. VERSION ONLY, AND MAY CONTAIN BUGS, ERRORS OR OTHER MALFUCTIONS, 
  104. FOR WHICH FINJAN DISCLAIMS ALL LIABILITY.

  106. NO LIABILITY FOR CONSEQUENTIAL DAMAGES  -  IN NO EVENT SHALL 
  107. FINJAN OR ITS SUPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL OR 
  108. INDIRECT DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, 
  109. DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS 
  110. OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF 
  111. THE USE OF OR INABILITY TO USE THIS FINJAN PRODUCT, EVEN IF 
  112. FINJAN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  113.  
  114. Some jurisdictions do not allow the exclusion of implied 
  115. warranties or limitations on how long an implied warranty may 
  116. last, or the exclusion or limitation of incidental or 
  117. consequential damages, so the above limitations or exclusions may 
  118. not apply to you.  This license gives you specific legal rights 
  119. and you may also have other rights which vary from jurisdiction 
  120. to jurisdiction.
  121.  
  122. This Agreement is governed by the laws of the State of Israel.
