  1. SHAREWARE SINGLE USER LICENSE AGREEMENT

  4. This is a user license agreement (the "AGREEMENT") between you (either individual
  5. or single entity) and 3Dize, for the shareware version of the software (the
  6. "SOFTWARE") accompanying this AGREEMENT.
  7.  
  8. The SOFTWARE is the property of 3Dize and is protected by copyright laws and
  9. international copyright treaties.  The SOFTWARE is not sold, it is licensed.
  10.  
  11. By availing of any of the rights licensed to you in this AGREEMENT, you agree
  12. to be bound by and are becoming a party to this AGREEMENT.  If you do not agree
  13. to these terms and conditions, do not avail of the rights licensed to you in this
  14. AGREEMENT.

  16. If you accept the terms and conditions of this AGREEMENT, you have certain non-
  17. exclusive rights and obligations as follow:
  18.  
  19. YOU MAY do any of the following:
  20.  
  21. 1.    Install and use the SOFTWARE for as long as you wish, except to use the
  22.     locked features of the Software, you must obtain an unlock code from
  23.     3Dize or a duly authorized representative of 3Dize.
  24.  
  25. 2.    Make unlimited copies and distribute the SOFTWARE in it's uninstalled,
  26.     unmodified form, as downloaded from 3Dize.  Computer's Magazines are
  27.     authorized to distribute the SOFTWARE (in it's uninstalled, unmodified
  28.     form, as downloaded from 3Dize) on any Cover Disk or CD-ROM.

  31. YOU MAY NOT do any of the following:
  32.  
  33. 1.    Distribute codes, or programs that generate codes, which unlock the
  34.     locked features in SOFTWARE, unless you have obtained a separate license
  35.     from 3Dize for such.
  36.  
  37. 2.    Remove the advertizement from files created by the SOFTWARE unless you
  38.     have obtained an unlock code from 3Dize or a duly authorized
  39.     representative of 3Dize.
  40.  
  41. 3.    Install or use this shareware version of the SOFTWARE on network server
  42.     such that it can be in use by multiple users simultaneously.  A separate
  43.     site license is available from 3Dize.
  44.  
  45. 4.    Sublicense, rent, or lease the SOFTWARE or any portion of it.
  46.  
  47. 5.    Decompile, disassemble, reverse engineer or modify the SOFTWARE or any
  48.     portion of it.
  49.  
  50. 6.    Incorporate the SOFTWARE in other computer programs.
  51.  
  52.  
  53. All other rights with respect to the SOFTWARE are reserved.

  58. The Software is provided "AS IS", without a warranty of any kind.
  59. ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND
  60. WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF
  61. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR
  62. NON-INFRINGEMENT, ARE HEREBY EXCLUDED.  3DIZE AND IT'S
  63. LICENSORS SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED
  64. BY LICENSEE AS A RESULT OF USING, MODIFYING OR
  65. DISTRIBUTING THE SOFTWARE OR ITS DERIVATIVES. IN NO
  66. EVENT WILL 3DIZE AND IT'S LICENSORS BE LIABLE FOR ANY
  67. LOST REVENUE, PROFIT OR DATA, OR FOR DIRECT, INDIRECT,
  68. SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES,
  69. HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY,
  70. ARISING OUT OF THE USE OF OR INABILITY TO USE SOFTWARE,
  71. EVEN IF 3DIZE HAS BEEN ADVISED OF THE POSSIBILITY OF
  72. SUCH DAMAGES.

  74. IN ANY EVENT, THE MAXIMUM LIMIT OF 3DIZE'S LIABILITY UNDER
  75. THIS AGREEMENT IS $5.
