  9. non-sublicensable, license to use this version of Wincode:
  10. Multi-Purpose Encoder/Decoder for Windows (the "Software"), in
  11. binary executable form for personal purposes only.

  13. 2. _SNAPPY_ MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF
  14. THIS SOFTWARE OR ABOUT ANY CONTENT OR INFORMATION MADE
  15. ACCESSIBLE BY THE SOFTWARE, FOR ANY PURPOSE.  THE SOFTWARE IS
  16. PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED WARRANTIES,
  17. INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A

  29. the applicable content owner and may be protected by applicable
  30. copyright law.  This License gives you no rights to such content.

  33. and to the Software shall remain in _Snappy_ and/or its
  34. suppliers.  You agree to abide by the copyright law and all
  35. other applicable laws of the United States including, but not
  36. limited to, export control laws.  You acknowledge that the
  37. Software in source code form remains a confidential trade secret
  38. of _Snappy_ and/or its suppliers and therefore you agree not to
  39. modify the Software or attempt to decipher, decompile,
  40. disassemble or reverse engineer the Software, except to the
  41. extent applicable laws specifically prohibit such restriction.

  43. 6. _Snappy_ reserves the right to alter and/or terminate this
  44. License and deny and/or prohibit individuals or corporations
  45. from using the Software.  _Snappy_ may terminate this License at
  46. any time by delivering notice to you and you may terminate this
  47. License at any time by destroying or erasing your copy of the
  48. Software.  Upon termination of this License, you agree to
  49. destroy or erase the Software.  In the event of termination, all
  50. applicable sections of this License will survive.  This License
  51. is personal to you and you agree not to assign your rights
  52. herein.  This License shall be governed by and construed in
  53. accordance with the laws of the State of New York and, as to
  54. matters affecting copyrights, trademarks and patents, by U.S.
  55. federal law. This License sets forth the entire agreement
  56. between you and _Snappy_.

  58. 7. _SNAPPY_ OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR (a)
  59. INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES OF ANY
  60. SORT, WHETHER ARISING IN TORT, CONTRACT OR OTHERWISE, EVEN IF
  61. _SNAPPY_ HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES,
  62. OR (b) FOR ANY CLAIM BY ANY OTHER PARTY. FURTHERMORE, IN STATES
  63. THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
  64. CONSEQUENTIAL DAMAGES, YOU MAY NOT USE THIS SOFTWARE.

  66. 8. _Snappy_ provides support for the Software in the form of a
  67. "Help Option".  The "Help Option" is considered a separate entity
  68. governed by a separate License.  It is in no way required for the
  69. Software to function.  The "Help Option" is provided separately
  70. for a one-time fee.  Online order forms are provided within the
  71. Software.  Prices are current to the date indicated and subject
  72. to change without notice.  The "Help Option" does not grant
  73. further rights to the Software.  A separate License for the "Help
  74. Option" is provided at the time of purchase.  _SNAPPY_ IS NOT
  75. RESPONSIBLE FOR LOST OR STOLEN ORDERS AND/OR "HELP OPTION"
  76. SOFTWARE SHIPMENTS. _SNAPPY_ RESERVES THE RIGHT TO DENY AND/OR
  77. LIMIT THE EXTENT OF SUPPORT PROVIDED BY THE "HELP OPTION".

  79. 10. THE SOFTWARE IS PROVIDED AS FREEWARE AND YOU MAY DISTRIBUTE
  80. IT AS SUCH PROVIDING YOU KEEP THE PROGRAM FILES, THE ASSOCIATED
  81. DATA FILES AND THE INTRODUCTORY TEXT FILES IN ORIGINAL INTACT
  82. CONDITION.  THE SOFTWARE MAY BE DISTRIBUTED IN SHAREWARE/FREEWARE
  83. PACKAGES IN WHICH FEES COVER DUPLICATION/MEDIA COSTS.
