  1. This software is an "evaluation" release of a Borland product.  
  2. Your use of the software is subject to the NO-NONSENSE LICENSE STATEMENT 
  3. AND LIMITED WARRANTY provided herein.

  6. NO-NONSENSE LICENSE STATEMENT AND LIMITED WARRANTY
  7. This software is protected by both United States copyright law
  8. and international treaty provisions.  You must treat this
  9. software just like a book, except that you may copy it onto a
  10. computer to be used and you may make an archival copy of the
  11. software for the sole purpose of backing up the software and
  12. protecting your investment from loss.
  13.  
  14. By saying "just like a book," Borland means, for example, that
  15. this software may be used by any number of people, and may be
  16. freely moved from one computer location to another, so long as
  17. there is no possibility of it being used at one location or on
  18. one computer while it is being used at another.  Just like a book
  19. cannot be read by two different people in two different places at
  20. the same time, neither can the software be used by two different
  21. people in two different places at the same time (unless, of
  22. course, Borland's copyright is being violated).

  24. EVALUATION SOFTWARE
  25. The software is an "evaluation" release of a Borland product.  You may 
  26. use the software for your own personal evaluation for the duration of the
  27. evaluation period indicated in the software. The evaluation period begins
  28. when you first install the software on one or more computers for evaluation
  29. purposes.  At the end of the evaluation period, the software will 
  30. automatically disable itself.  To continue using the software beyond the 
  31. evaluation period, you will need to first purchase a regular release of 
  32. the Borland product.

  34. You agree to indemnify and hold harmless Borland, its related companies 
  35. and its suppliers, from and against any claims or liabilities arising out 
  36. of the use, reproduction or distribution of your own programs which you 
  37. create or use with the software.

  39. LIMITED WARRANTY 
  40. Borland warrants the physical media provided by Borland to be free of 
  41. defects in materials and workmanship for a period of ninety (90) days 
  42. from the original purchase date.  If Borland receives notification within 
  43. the warranty period of defects in materials or workmanship, and determines 
  44. that such notification is correct, Borland will replace the defective
  45. media.  DO NOT RETURN ANY PRODUCT UNTIL YOU HAVE CALLED THE BORLAND 
  46. CUSTOMER SERVICE DEPARTMENT AND OBTAINED A RETURN AUTHORIZATION NUMBER.

  48. The entire and exclusive liability and remedy for breach of this limited 
  49. warranty shall be limited to replacement of defective media and shall not 
  50. include or extend to any claim for or right to recover any other damages, 
  51. including but not limited to, loss of profit, data or use of the software 
  52. or special, incidental or consequential damages, or other similar claims, 
  53. even if Borland has been specifically advised of the possibility of such 
  54. damages.  In no event will Borland's liability for any damages to you or 
  55. any other person ever exceed the lower of the list price or the actual 
  56. price paid for the package or the license to use the software, regardless 
  57. of the form of the claim.

  59. BORLAND SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, REPRESENTATIONS OR 
  60. CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED 
  61. WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR 
  62. PURPOSE.  ALL OTHER IMPLIED TERMS ARE EXCLUDED.

  64. Specifically, Borland makes no representation or warranty that the software
  65. is "error free," or meets any user's particular standards, requirements 
  66. or needs.  In all events, any implied warranty, representation, condition 
  67. or other term is limited to the physical media and is limited to the 90-day
  68. duration of the limited warranty.

  70. Borland is not responsible for, and does not make any representation, 
  71. warranty or condition concerning product, media, software not manufactured 
  72. or supplied by Borland, such as third parties' programs which are designed 
  73. using Borland software or which include Borland programs or files.
  74.  
  75. GENERAL PROVISIONS    
  76. This statement may only be modified in writing signed by you and an 
  77. authorized officer of Borland.  If any provision of this statement is 
  78. found void or unenforceable, the remainder will remain valid and 
  79. enforceable according to its terms.  If any remedy provided is determined 
  80. to have failed its essential purpose, all limitations of liability and 
  81. exclusions of damages set forth in the limited warranty shall remain in 
  82. effect.  Use, duplication or disclosure of the software in this package 
  83. by the U.S. Government is subject to the restricted rights applicable to 
  84. commercial computer software (under FAR 52.227-19 and DFARS 52.227-7013).

  86. This statement shall be construed, interpreted and governed by the laws of 
  87. the State of California, U.S.A.  This statement gives you specific legal 
  88. rights; you may have others which vary from state to state and from 
  89. country to country.  Borland reserves all rights not specifically granted 
  90. in this statement.
