  46.  SOFTWARE LICENSE

  48.  Non-licensed users are granted a limited license to use
  49.  WinXFiles on a 30-day trial basis for the purpose of
  50.  determining whether WinXFiles is suitable for their
  51.  needs.  The use of WinXFiles, except for the initial
  52.  30-day trial, requires registration.  The use of
  53.  unlicensed copies of WinXFiles, outside of the initial
  54.  30-day trial, by any person, business, corporation,
  55.  government agency or any other entity is strictly
  56.  prohibited.
  57.  
  58.  A license for personal use that grants
  59.  the user the right to use WinXFiles on one computer may be purchased.
  60.  A commercial license requires sufficient licensing
  61.  equal to the number of users, or the quantity
  62.  of workstations that access the software, whichever is
  63.  smaller.
  64.  
  65.  No one may modify or patch the WinXFiles executable files
  66.  in any way, including but not limited to decompiling,
  67.  disassembling, or otherwise reverse engineering the
  68.  programs.

  70.  A limited license is granted to copy and distribute
  71.  WinXFiles only for the trial use of others, subject
  72.  to the above limitations, and also the following:
  73.  
  74.   1)    WinXFiles and all of its release files must be
  75.         copied in unmodified form, complete with the file
  76.         containing this license information.

  78.   2)    No fee, charge, or other compensation may be requested
  79.         or accepted, except as authorized below:
  80.  
  81.         A) Operators of electronic bulletin board systems
  82.            (sysops) may make WinXFiles available for down-
  83.            loading only as long as the above conditions are
  84.            met.  An overall or time-dependent charge for the
  85.            use of the bulletin board system is permitted as
  86.            long as there is not a specific charge for the
  87.            download of WinXFiles.

  89.         B) Vendors of user-supported or shareware software
  90.            approved by the ASP may distribute WinXFiles,
  91.            subject to the above conditions, without specific
  92.            permission.

  94.         C) Non-profit user groups may distribute copies of
  95.            the WinXFiles diskette to their members,
  96.            subject to the above conditions, without specific
  97.            permission.  Non-profit groups may collect a disk
  98.            duplication fee not to exceed five dollars.

  100.   LIMITED WARRANTY

  102.   PEPSOFTWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR
  103.   IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES
  104.   OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,
  105.   WITH RESPECT TO THE PRODUCT.  SHOULD THE PROGRAM PROVE
  106.   DEFECTIVE, THE PURCHASER ASSUMES THE RISK OF PAYING THE
  107.   ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR 
  108.   CORRECTION AND ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
  109.   IN NO EVENT WILL PEPSOFTWARE BE LIABLE FOR ANY DAMAGES WHATSOEVER
  110.   (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF
  111.   BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS
  112.   INFORMATION AND THE LIKE) ARISING OUT OF THE USE OR THE
  113.   INABILITY TO USE THIS PRODUCT EVEN IF PEPSOFTWARE
