  54.  SOFTWARE LICENSE
  55.  
  56.  Non-licensed users are granted a limited license to use
  57.  WinXFiles on a 30-day trial basis for the purpose of
  58.  determining whether WinXFiles is suitable for their
  59.  needs.  The use of WinXFiles, except for the initial
  60.  30-day trial, requires registration.  The use of
  61.  unlicensed copies of WinXFiles, outside of the initial
  62.  30-day trial, by any person, business, corporation,
  63.  government agency or any other entity is strictly
  64.  prohibited.
  65.  
  66.  A license for personal use that grants
  67.  the user the right to use WinXFiles on one computer may be purchased.
  68.  A commercial license requires sufficient licensing
  69.  equal to the number of users, or the quantity
  70.  of workstations that access the software, whichever is
  71.  smaller.

  73.  No one may modify or patch the WinXFiles executable files
  74.  in any way, including but not limited to decompiling,
  75.  disassembling, or otherwise reverse engineering the
  76.  programs.

  78.  A limited license is granted to copy and distribute
  79.  WinXFiles only for the trial use of others, subject
  80.  to the above limitations, and also the following:
  81.  
  82.   1)    WinXFiles and all of its release files must be
  83.         copied in unmodified form, complete with the file
  84.         containing this license information.

  86.   2)    No fee, charge, or other compensation may be requested
  87.         or accepted, except as authorized below:
  88.  
  89.         A) Operators of electronic bulletin board systems
  90.            (sysops) may make WinXFiles available for down-
  91.            loading only as long as the above conditions are
  92.            met.  An overall or time-dependent charge for the
  93.            use of the bulletin board system is permitted as
  94.            long as there is not a specific charge for the
  95.            download of WinXFiles.

  97.         B) Vendors of user-supported or shareware software
  98.            approved by the ASP may distribute WinXFiles,
  99.            subject to the above conditions, without specific
  100.            permission.

  102.         C) Non-profit user groups may distribute copies of
  103.            the WinXFiles diskette to their members,
  104.            subject to the above conditions, without specific
  105.            permission.  Non-profit groups may collect a disk
  106.            duplication fee not to exceed five dollars.

  108.   LIMITED WARRANTY
  109.  
  110.   PEPSOFTWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR
  111.   IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES
  112.   OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,
  113.   WITH RESPECT TO THE PRODUCT.  SHOULD THE PROGRAM PROVE
  114.   DEFECTIVE, THE PURCHASER ASSUMES THE RISK OF PAYING THE
  115.   ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR 
  116.   CORRECTION AND ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
  117.   IN NO EVENT WILL PEPSOFTWARE BE LIABLE FOR ANY DAMAGES WHATSOEVER
  118.   (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF
  119.   BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS
  120.   INFORMATION AND THE LIKE) ARISING OUT OF THE USE OR THE
  121.   INABILITY TO USE THIS PRODUCT EVEN IF PEPSOFTWARE
  122.   HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
