  1. SOFTWARE LICENSE AGREEMENT

  3. Keith Woodard ("LICENSER") IS WILLING TO LICENSE THE
  4. ACCOMPANYING SOFTWARE TO YOU ONLY IF YOU ACCEPT ALL OF THE TERMS IN
  5. THIS LICENSE AGREEMENT.  PLEASE READ THE TERMS CAREFULLY BEFORE YOU
  6. INSTALL THE SOFTWARE, BECAUSE BY INSTALLING THE SOFTWARE YOU ARE
  7. AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT
  8. AGREE TO THESE TERMS, LICENSER WILL NOT LICENSE THIS SOFTWARE TO YOU,
  9. AND IN THAT CASE YOU SHOULD IMMEDIATELY DELETE ALL COPIES OF THIS
  10. SOFTWARE YOU HAVE IN ANY FORM.

  16. OWNERSHIP OF THE SOFTWARE

  18. 1. The enclosed Licenser software program ("Software") and the
  19. accompanying written materials are owned by Licenser or its suppliers
  20. and are protected by United States copyright laws, by laws of other
  21. nations, and by international treaties.
  22.  
  23. GRANT OF LICENSE
  24.  
  25. 2.  If you have purchased a per copy license to the Software, Licenser
  26. grants to you the right to use one copy of the Software on a single
  27. computer.  If the Software consists of multiple executable programs
  28. then individually each of those executable programs can be used only
  29. on a single computer, but there is no requirement that all executables
  30. must be used on the same single computer.

  32. 3. If you have not yet purchased a license to the Software, Licenser
  33. grants to you the right to use one copy of the Software on a single
  34. computer for an evaluation period of 10 days.  If you wish to continue
  35. using the Software and accompanying written materials after the
  36. evaluation period, you must register the Software by sending the
  37. required payment to Licenser. You will then receive a license for
  38. continued use and a registration code that will permit you to use the
  39. Software free of payment reminders.  The Software may come with extra
  40. programs and features that are available for use only to registered
  41. users through the use of their registration code.

  43. RESTRICTIONS ON USE AND TRANSFER
  44.  
  45. 4. You may distribute the Software and accompanying written materials
  46. to others so long as all the files comprising the Software and
  47. accompanying written materials are passed to the user without
  48. modification and that a clear statement is made to the receiver of the
  49. distribution that you are in no way transferring or assigning rights
  50. to the Software.  The Licenser may revoke the right to distribute the
  51. Software at any time, with or without cause, by giving 10 days written
  52. notice to the distributor.

  54. 5. You may make printed copies of the written materials accompanying
  55. Software provided that they used only by users bound by this license.
  56.  
  57. 6. You may not distribute or transfer your registration code or
  58. transfer the rights given by the registration code.
  59.  
  60. 7. You may not rent or lease the Software or otherwise transfer or
  61. assign the right to use the Software.
  62.  
  63. 8. You may not reverse engineer, decompile, or disassemble the
  64. Software.
  65.  
  66. DISCLAIMER OF WARRANTY
  67.  
  68. 9.  THIS SOFTWARE AND ITS ACCOMPANYING WRITTEN MATERIALS ARE PROVIDED
  69. BY LICENSER "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING,
  70. BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS
  71. FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE DISCLAIMED.

  73. 10. IN NO EVENT SHALL LICENSER OR ITS SUPPLIERS BE LIABLE FOR ANY
  74. DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL
  75. DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE
  76. GOODS OR SERVICES; LOSS OF USE, DATA, SAVINGS, OR PROFITS; OR BUSINESS
  77. INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER
  78. IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR
  79. OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF
  80. ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

  82. Because some states do not allow the exclusion or limitation of
  83. liability for consequential or incidental damages, the above
  84. limitation may not apply to you.

  86. 11. This Agreement is governed by the laws of the State of Virginia.

  92. US GOVERNMENT RESTRICTED RIGHTS

  94. 13. The Software and documentation are provided with RESTRICTED
  95. RIGHTS. Use, duplication, or disclosure by the Government is subject
  96. to restrictions set forth in subparagraph (c)(1) of The Rights in
  97. Technical Data and Computer Software clause at DFARS 252.227-7013 or
  98. subparagraphs (c)(1)(ii) and (2) of Commercial Computer Software -
  99. Restricted Rights at 48 CFR 52.227-19, as applicable. Supplier is Keith
