  2. Please read the license agreement below.

  4. The following windows will guide you through the
  5. install of Java for OS/2.  See the READ.ME for more
  6. information.

  9. to stop the installation.

  11. IBM LICENSE AGREEMENT FOR JAVA FOR OS/2

  13. THIS IS A LEGAL AGREEMENT BETWEEN 
  14. YOU (EITHER AN INDIVIDUAL OR AN ENTITY) 
  15. AND THE IBM CORPORATION.  BEFORE 
  16. DOWNLOADING OR USING THE CODE AND/OR 
  17. DOCUMENTATION (HEREINAFTER "PROGRAM") 
  18. YOU SHOULD CAREFULLY READ THE 
  19. FOLLOWING  TERMS AND CONDITIONS.  
  20. DOWNLOADING OR USING THE PROGRAM 
  21. INDICATES YOUR ACCEPTANCE OF THESE 
  22. TERMS AND CONDITIONS.  IF YOU DO NOT 
  23. AGREE TO THE TERMS AND CONDITIONS 
  24. OF THIS AGREEMENT, YOU MAY NOT DOWNLOAD 
  25. OR USE THE PROGRAM.

  27. I.  GRANT OF LICENSE.  Subject to 
  28. the terms and conditions of this 
  29. Agreement, IBM grants to you a
  30. non-exclusive, non-transferable, 
  31. non-assignable right, under the 
  32. applicable IBM copyrights, to use one 
  33. copy of the PROGRAM on only one machine 
  34. at any one time.

  36. You may not copy, modify or merge 
  37. copies of the PROGRAM except as provided 
  38. in this Agreement.  You may not  
  39. rent, lease, sell, sublicense, assign, 
  40. distribute or otherwise transfer 
  41. the PROGRAM except as provided in this 
  42. Agreement.  You may not  reverse 
  43. compile or reverse assemble any part of 
  44. the PROGRAM, except as specifically 
  45. permitted by law without the 
  46. possibility of contractual waiver.

  48. II. COPYRIGHT.  The PROGRAM is licensed 
  49. not sold.  The PROGRAM is owned by 
  50. IBM or its suppliers and is protected 
  51. by United States copyright laws.  
  52. You may make one copy of the PROGRAM 
  53. for backup purposes.  You must 
  54. reproduce the copyright notice(s) 
  55. on such copy of the PROGRAM.

  57. III.  TERM AND TERMINATION.  You may 
  58. terminate your license to the PROGRAM 
  59. at any time by destroying all of your 
  60. copies of the PROGRAM.  In addition, 
  61. IBM may terminate your license to the 
  62. PROGRAM if you fail to comply with 
  63. all the terms and conditions of this 
  64. Agreement.  Upon termination, you 
  65. agree to destroy all your copies of 
  66. the PROGRAM.

  68. IV.  DISCLAIMERS.  SUBJECT TO ANY 
  69. STATUTORY WARRANTIES WHICH CAN NOT BE 
  70. EXCLUDED, IBM MAKES NO WARRANTIES 
  71. OR CONDITIONS EITHER EXPRESS OR IMPLIED,
  72.  INCLUDING, WITHOUT LIMITATION, THE 
  73. WARRANTY OF NON-INFRINGEMENT AND THE 
  74. IMPLIED WARRANTIES OF MERCHANTABILITY 
  75. AND FITNESS FOR A PARTICULAR PURPOSE, 
  76. REGARDING THE PROGRAM.

  79. IN NO EVENT WILL IBM OR ITS SUPPLIERS 
  80. BE LIABLE FOR ANY INCIDENTAL, 
  81. INDIRECT, SPECIAL OR CONSEQUENTIAL 
  82. DAMAGES INCLUDING, BUT NOT LIMITED TO, 
  83. LOST PROFITS AND LOST SAVINGS, UNDER 
  84. ANY PART OF THIS AGREEMENT EVEN IF 
  85. IBM, OR ITS SUPPLIER, HAS BEEN ADVISED 
  86. OR IS AWARE OF THE POSSIBILITY OF 
  87. SUCH DAMAGES.  IN ADDITION, IBM WILL 
  88. NOT BE LIABLE FOR ANY DAMAGES CLAIMED 
  89. BY YOU BASED ON ANY THIRD PARTY CLAIM.

  92. V.  GENERAL.  If you use the PROGRAM 
  93. in the United States, this license is 
  94. governed by the substantive laws of 
  95. the State of  New York (excluding 
  96. choice of law rules).  If you use the 
  97. PROGRAM in Canada this license is 
  98. governed by the laws of the Province 
  99. of Ontario.  Otherwise, this license 
  100. is governed by the laws of the country 
  101. in which you use the PROGRAM.
