  4. a trademark of LSI Logic Corporation.

  6. Without an executed license agreement between you and LSI Logic
  7. Corporation, possession of the software contained herein does not 
  8. imply or grant a license or a commitment by LSI Logic either 
  9. express or implied to provide any portion of the software for
  10. production purposes. LSI Logic further reserves the right to 
  11. change or improve the software without notice.

  13. Use of the enclosed software is strictly limited to demonstrating and 
  14. evaluating the operation of selected LSI Logic SCSI controllers at 
  15. your facility only.

  17. UNTIL A LICENSE AGREEMENT BETWEEN YOU AND LSI LOGIC CORPORATION HAS 
  18. BEEN SIGNED, THE FOLLOWING TERMS AND CONDITIONS SHALL APPLY:

  22.    The SDMS software is owned by LSI Logic Corporation and is 
  23.    protected by United States copyright laws and international treaty 
  24.    provisions. You may not alter or remove any copyright notices which
  25.    LSI Logic has caused to appear in the software or documentation.

  27. 2. OTHER RESTRICTIONS.

  29.    You may not modify, make a derivative work of, rent, lease, distribute, 
  30.    market, or sublicense the software. You may not reverse engineer,
  31.    decompile, or disassemble any portion of the software.

  33. 3. WARRANTY.

  35.    ANY USE BY YOU OF THE SOFTWARE IS AT YOUR OWN RISK. THE SOFTWARE IS
  36.    PROVIDED FOR USE ONLY WITH SDMS SEMICONDUCTOR DEVICES. THE SOFTWARE IS
  37.    PROVIDED FOR USE "AS IS" WITHOUT WARRANTY OF ANY KIND. LSI LOGIC
  38.    DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED,
  39.    INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF 
  40.    MERCHANTABILITY, NONINFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.

  42. 4. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

  44.    In no event shall LSI Logic Corporation be liable for any special, 
  45.    incidental, indirect, or consequential damages (including, without 
  46.    limitation, damages for loss of business profits, business 
  47.    interruption, loss of business information, or other pecuniary loss)
  48.    arising out of the use or inability to use this LSI Logic product, 
  49.    even if LSI Logic has been advised of the possibility of such damages.

  51. 5. U.S. GOVERNMENT RESTRICTED RIGHTS.

  53.    The SDMS software and documentation are provided with  RESTRICTED RIGHTS. 
  54.    Use, duplication, or disclosure by the Government is subject to 
  55.    restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in 
  56.    Technical Data and Computer Software clause at DFARS 252.227-7013 or
  57.    subparagraphs (c)(1) and (2) of the Commercial Computer Software - 
  58.    Restricted Rights at 48 CFR 52.227 19, as applicable.  Manufacturer is
