  8. IMPORTANT - READ CAREFULLY:
  9. This License Agreement ("License") is a legal agreement between you
  10. (individual or a legal entity) and the mentioned author of the software
  11. product "jv16 PowerTools".

  13. YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE BY
  14. INSTALLING, COPYING, DISTRIBUTING OR OTHERWISE USING
  15. JV16 POWERTOOLS. IF YOU DO NOT AGREE, DO NOT INSTALL,
  16. DISTRIBUTE OR USE JV16 POWERTOOLS IN ANY WAYS.

  38. 1. DEFINITIONS
  39.  
  40. "jv16 PowerTools" means the jv16 PowerTools software product
  41.   and everything included in its official distribution
  42.   packages, such as the documentation, all the plug-in
  43.   applications and modules, and all the network applications.
  44.  
  45. "the Author" means the creator and the developer of the
  46.   "jv16 PowerTools" software product, a private individual
  47.   called Jouni Vuorio living in Espoo, Finland.
  48.  
  49. "Licensed version" means a version of jv16 PowerTools that has
  50.   been licensed for use in a company or in an organization.
  51.   Licensed version is not free and you are not allowed to
  52.   distribute it.
  53.  
  54. "Unlicensed version" means the free version of jv16 PowerTools
  55.   that can only be used in personal, non-commercial use.
  56.  
  57. "personal, non-commercial use" means the use of jv16 PowerTools in
  58.   your own home, with your own personal computer by you, your family or
  59.   by your close friends. The computer you use jv16 PowerTools in must
  60.   be owned by you or by a member of your family, you are not allowed
  61.   to use an unlicensed version of jv16 PowerTools in a computer
  62.   owned by the company you work for.

  64. "official distribution package" means a package file, such as .zip or
  65.   .rar archive or a self extracting ("SFX") version of such archive, or
  66.   an installation program containing jv16 PowerTools which can be
  67.   downloaded from the Author's official home page, at the present moment
  68.   "www.vtoy.fi/jv16/" and it's mirror service "www.jv16.org".

  71. 2. WARNING

  73. jv16 PowerTools is protected by copyright laws and international
  74. copyright treaties as well as other intellectual property laws and
  75. treaties. Unauthorized reproduction or distribution of the
  76. jv16 PowerTools, or any portion of it, may result in severe criminal
  77. and civil penalties, and will be prosecuted to the maximum extent
  78. possible under law.

  81. 3. GRANT OF LICENSE
  82.  
  83. The Author grants you the following rights provided that you
  84. comply with all terms and conditions of this License:

  86.   1. Usage. You may install, use, access, display and run jv16 PowerTools
  87.      in so many computers that the license you own allows you to.
  88.      The unlicensed version allows you to use jv16 PowerTools in an
  89.      unlimited amount of computers. If you don't know how many computers
  90.      your license allow you to use you can find out that by starting
  91.      jv16 PowerTools and pressing the F2 key from you keyboard.

  94. 4. RESTRICTIONS AND LIMITATIONS OF USE

  96. You are not allowed to:

  98.   1. Modify, reverse engineer, decompile, disassemble or otherwise
  99.      attempt to reconstruct or discover the source code, or any parts
  100.      of it, from the binaries of jv16 PowerTools.
  101.  
  102.   2. Modify, reverse engineer, decompile, disassemble or otherwise
  103.      attempt to reconstruct or discover any mechanism, algorithm or
  104.      a protocol created by the Author and which is used in the
  105.      jv16 PowerTools.
  106.  
  107.   3. Create, develop, distribute, use, install or store in your
  108.      computer a program, source code, mechanism, method or
  109.      algorithm to bypass or to brake jv16 PowerTools' security
  110.      features, license validation, license creation, user account
  111.      creation, user account validation, network packet creation or
  112.      network package validation.
  113.  
  114.   4. Create derivative works based on jv16 PowerTools (e.g. incorporating
  115.      jv16 PowerTools in a commercial product or service without a proper
  116.      license), except that you may create bug fixes.
  117.  
  118.   5. Rent, lease, sublicense, convey, distribute or otherwise
  119.      transfer rights to jv16 PowerTools.
  120.  
  121.   6. Remove any product identification, copyright, proprietary
  122.      notices or labels from jv16 PowerTools.
  123.  
  124.   7. Distribute, re-distribute, rent, lease or sell the licensed
  125.      version of jv16 PowerTools or any portions of it or the license
  126.      itself or any portions of the license without a written permission
  127.      from the Author.

  129.   8. Sell, re-sell, rent or lease jv16 PowerTools, any portions
  130.      of it or its license or any portions of a license without
  131.      written permission from the Author.

  133.   9. Distribute jv16 PowerTools in any other form than in the
  134.      official distribution packages.

  136.   10. Use the licensed version of jv16 PowerTools if you do not
  137.       have a valid license or if you do not know who
  138.       (either individual or a legal entity) has bought the license for you.

  140.   11. Use the licensed version of jv16 PowerTools if you know that
  141.       the copy you are using is illegal or the license itself is illegal
  142.       or faked.

  144.   12. Use, run, copy, distribute or store jv16 PowerTools in your computer
  145.       if this license is violated in any ways.

  149. 5. TERMINATION OF LICENSE
  150.  
  151. The Author has the right to terminate this license if you do
  152. not abide by the terms and conditions of this license,
  153. in which case you must destroy all copies of jv16 PowerTools
  154. and all of its component parts.

  157. 6. MAINTENANCE, SUPPORT AND UPDATES
  158.  
  159. the Author is under no obligation to maintain, support or
  160. update jv16 PowerTools in any way, or to provide updates or error
  161. corrections.

  164. 7. CONFIDENTIALITY
  165.  
  166. Licensed version of jv16 PowerTools and any license authorization
  167. codes (such as "license.dat") are confidential. You agree to take
  168. adequate steps to protect jv16 PowerTools and any license authorization
  169. codes and "license.dat" file from unauthorized disclosure or use.
  170. You agree that you will not disclose the licensed version of
  171. jv16 PowerTools, any parts of it, its license or any parts of the
  172. license to any third party.

  175. 8. DISCLAIMER
  176.  
  177. The Author expressly disclaims all warranties, whether express, implied
  178. or statutory, including, without limitation, the implied warranties of
  179. merchantability, of fitness for a particular purpose, noninfringement
  180. of third party intellectual property rights, and any warranty that may
  181. arise by reason of trade usage, custom, or course of dealing. Without
  182. limiting the foregoing, you acknowledge that jv16 PowerTools is provided
  183. "as is" and that the Author does not warrant that jv16 PowerTools will run
  184. uninterrupted or error free nor that jv16 PowerTools will operate with
  185. hardware and/or software not provided by the Author. This disclaimer
  186. of warranty constitutes an essential part of the agreement. Some states
  187. do not allow the exclusion of implied  warranties, so the above exclusion
  188. may not apply to you, and you may have other rights, which vary from
  189. state to state.

  192. 9. LIMITED LIABILITY

  194. The entire risk as to results and performance of jv16 PowerTools is assumed
  195. by you. Under no circumstances will the Author or his licensors be liable
  196. for any direct or special, indirect, incidental, exemplary or consequential
  197. damages of any kind or nature whatsoever, whether based on contract,
  198. warranty, tort (including negligence), strict liability or otherwise,
  199. arising out of or in any way related to jv16 PowerTools or this agreement,
  200. even if the Author or his licensors have been advised of the possibility
  201. of such damage or if such damage could have been reasonably foreseen,
  202. and notwithstanding any failure of essential purpose of any exclusive
  203. remedy provided in this agreement. Such limitation on damages includes,
  204. but is not limited to, damages for loss of goodwill, lost profits, loss
  205. of data or software, work stoppage, computer failure or malfunction or
  206. impairment of other goods. In no event will the Author or his licensors
  207. be liable for the costs of procurement of substitute Software or services.
  208. in addition, in no event will the total liability of the Author in connection
  209. with this agreement or jv16 PowerTools exceed the actual amount paid to the
  210. author, if any, for jv16 PowerTools giving rise to the claim. You acknowledge
  211. that jv16 PowerTools is not designed or licensed for use in on-line equipment
  212. in hazardous environments such as operation of nuclear facilities, aircraft
  213. navigation or control, or life-critical applications. The Author expressly
  214. disclaims any liability resulting from use of jv16 PowerTools in any such
  215. on-line equipment in hazardous environments and accepts no liability in
  216. respect of any actions or claims based on the use of jv16 PowerTools in any
  217. such on-line equipment in hazardous environments by you. For purposes of
  218. this paragraph, the term "life-critical application" means an application
  219. in which the functioning or malfunctioning of jv16 PowerTools may result directly
  220. or indirectly in physical injury or loss of human life.

  223. 10. DISTRIBUTING
  224.  
  225. Unlicensed version of jv16 PowerTools may be freely distributed provided
  226. that it is not modified in any ways and that the original distribution package
  227. remains intact with all accompanying files, and provided that no fee is
  228. charged (except for any reasonable fees necessary to cover costs of
  229. distribution media), and that this license agreement is not violated
  230. in any ways. You are not allowed to include jv16 PowerTools to any
  231. commercial CD-ROM or DVD software collection without a written permission
  232. from the Author. The Author reserves the right to deny you from distributing
  233. jv16 PowerTools even if you haven't violated this license.

  236. 11. RESERVATION OF RIGHTS

  238. The Author reserves all rights not expressly granted to you in this License.
