  4. Thank you for download Go-Get-It 2.0--the fastest way to surf the 'net!
  5.  
  6. This file is divided into six sections.
  7.

  15. 1. Installation
  16. ---------------
  17.  
  18. This archive contains a program called SETUP.EXE. Run this program by
  19. double-clicking on its ICON in Windows File Manager or Windows 95 explorer.
  20.  
  21. First, you are presented with a notice from Home Page Press. This notice
  22. informs you about the current status of Go-Get-It and any special offers that
  23. may be available from Home Page Press. When you are done reading the notice,
  24. click "Continue."
  25.  
  26. Next, you are prompted to enter the name of the directory where you want
  27. Go-Get-It installed. This is usually C:\GOGETIT, but you can change it to any
  28. directory you like. When you're done, click "Next."
  29.  
  30. Once you click next, the setup program will begin installing Go-Get-It. You
  31. can tell how the installation is going by looking at the progress bar at the
  32. bottom of your screen.
  33.  
  34. Once the installation is completed, the setup program prompts you to enter the
  35. name of the Folder/Program group where you want Go-Get-It's icons to be
  36. created. The default is "Go-Get-It", which is usually okay, but you may change
  37. it to anything you like. When you're done, click "Create" and Go-Get-It's
  38. icons will be created. If you don't want to create icons for Go-Get-It, click
  39. "Skip."
  40.  
  41. Finally, you should see a message telling you that the installation is
  42. complete. Click OK and you can begin using Go-Get-It immediately!
  43.  
  44. 2. Running Go-Get-It for the first time
  45. ---------------------------------------
  46.  
  47. To run Go-Get-It, double click on the "Go-Get-It" icon that the setup program
  48. created. If you're using the trial version of Go-Get-It, a box will pop-up
  49. asking informing you of the number of days left in your trial period. The
  50. trial version of Go-Get-It will only work for 15 days after you first install
  51. the software. If you see this message, click "OK" and you can begin using
  52. Go-Get-It. Registered owners of Go-Get-It can begin using it immediately
  53. without that annoying message.

  55. 3. Unlocking the trial version of the software
  56. ----------------------------------------------
  57.  
  58. If you're a registered owner of Go-Get-It, you should have received a
  59. registration key from us by e-mail. To register the software (and eliminate
  60. the messages in the trial version), click on the "Register" button when the
  61. "You have X days remaining in your trial period..." screen appears. Enter your
  62. registration code and click OK. Now you're registered!
  63.  
  64. 4. Getting technical support
  65. ----------------------------
  66.  
  67. We've worked very hard to make sure that Go-Get-It runs as trouble-free as
  68. possible. However, sometimes problems are inevitable and the help file (you
  69. DID read the help file, didn't you?) is not sufficient to answer your
  70. questions.
  71.  
  72. In these cases, send an e-mail message to support@hpp.com. Home Page Press
  73. *only* provides e-mail support. We cannot answer phone or fax questions.
  74.  
  75. In your e-mail, please describe, as fully as possible, *exactly* what caused
  76. the problem. Provide URLs, if necessary.
  77.  
  78. Once you send a support request, you should receive a response within 48 hours
  79. (and usually a lot sooner).
  80.  
  81. 5. Ordering information

  175. HOME PAGE PRESS agrees to grant to you and you accept a non-exclusive,
  176. nontransferable license to use the Software contained herein  (the
  177. Licensed  Software) and related documentation under the following terms
  178. and conditions :

  180. 1.  LICENSE. HOME PAGE PRESS, INC. authorizes you to use and display the
  181. Licensed Software on the number of central processing units for which a
  182. license fee has been paid. You may physically transfer the Licensed
  183. Software from one CPU to another, provided that the Licensed Software is
  184. available for use on only one CPU at a time. You may install the Licensed
  185. Software on a network server which allows simultaneous use by multiple
  186. users, but a license fee must have been paid for each and every CPU which
  187. will use the Licensed Software. With respect to each of the above
  188. permitted uses, the LICENSE is granted only to the extent a license fee
  189. has been paid for each CPU on which the Licensed Software is or will be
  190. used at any time, regardless of whether the use is or is not concurrent or
  191. simultaneous with other users. You may not sub-license, rent, distribute,
  192. lease or otherwise assign your rights in the Licensed Software. The
  193. license is not a sale of the Licensed Software and HOME PAGE PRESS, INC.
  194. retains full title to the software recorded on the media contained in the
  195. Licensed Software. HOME PAGE PRESS, INC. reserves all rights not expressly
  196. granted to you in this LICENSE.

  198. 2.  TERMS. This License is effective from the date you open this package
  199. or use the Licensed Software, and shall remain in effect until terminated.
  200. You may terminate this License by destroying all complete and partial
  201. copies of the Licensed Software in your possession. The License shall
  202. terminate immediately if you fail to comply with any of its terms, in
  203. which case you will certify to in writing that, to the best of your
  204. knowledge, the original and all copies or partial copies of the Licensed
  205. Software have been destroyed or returned to HOME PAGE PRESS, INC..
  206.  
  207. 3.  RIGHTS IN LICENSED SOFTWARE. You acknowledge that the Licensed
  208. Software and any copies of it, regardless of the form or media in which
  209. the original or copies may exist, are the sole and exclusive property of
  210. HOME PAGE PRESS, INC., and you further acknowledge that the Licensed
  211. Software, including the code, logic and structure, constitute valuable
  212. trade secret rights that belong to HOME PAGE PRESS, INC.. You agree to
  213. secure and protect the Licensed Software consistent with the maintenance
  214. of HOME PAGE PRESS, INC. rights in it, as set forth in this License. By
  215. accepting this License, you do not become the owner of the Licensed
  216. Software; HOME PAGE PRESS, INC. retains full title to the software
  217. recorded on the media contained in the Licensed Software.
  218.  
  219. 4.  COPIES AND OTHER RESTRICTIONS. The Licensed Software is copyrighted
  220. under the laws of the United States and international treaty provisions.
  221. Notwithstanding the copyright, the Licensed Software contains trade
  222. secrets and confidential information of HOME PAGE PRESS, INC.. You agree
  223. not to disclose or otherwise make available any part of the Licensed
  224. Software to any third party except as permitted as part of an Application.
  225. You may make copies in machine-readable form of the computer program which
  226. is part of the Licensed Software, provided that the copies are used only
  227. for back-up or archival purposes, that no more than two complete or
  228. partial copies exist at any time, and that the copies contain the original
  229. copyright notice. You also agree not to make any copies of the
  230. documentation which is part of the Licensed Software.
  231.  
  232. 5.  WARRANTY. The Licensed Software is warranted for a period of one year
  233. to substantially conform to HOME PAGE PRESS, INC.'S Software Product
  234. Description applicable at the time of order. HOME PAGE PRESS, INC.'S sole
  235. obligation shall be to remedy any non-conformance of the software within a
  236. reasonable time after Buyer notifies HOME PAGE PRESS, INC. in writing of
  237. any defect. This warranty does not cover any modifications to the Software
  238. made by any person other than HOME PAGE PRESS, INC., or any defects caused
  239. by or otherwise related to such modifications. FURTHER HOME PAGE PRESS,
  240. INC. DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING
  241. THE USE, OR THE RESULTS OF THE USE, OF THE LICENSED SOFTWARE OR ITS
  242. DOCUMENTATION IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENCY OR
  243. OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE
  244. SOFTWARE IS ASSUMED BY YOU. THE ABOVE ARE THE ONLY WARRANTIES OF ANY KIND;
  245. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY HOME PAGE PRESS, INC. OR
  246. ITS EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF
  247. THIS WARRANTY, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.

  249. Any INSTALLATION by HOME PAGE PRESS, INC. of the Licensed Software is the
  250. sole responsibility of the end user, unless installation is provided by
  251. HOME PAGE PRESS, INC. or HOME PAGE PRESS, INC.'S authorized agent under
  252. the terms of a separate  agreement  with HOME PAGE PRESS, INC. or that
  253. agent. HOME PAGE PRESS, INC.  does not accept responsibility to install
  254. the Licensed Software. Should HOME PAGE PRESS, INC., or it's authorized
  255. agent, at its option, install the Licensed Software, HOME PAGE PRESS, INC.
  256. shall have no liability for any damage which may result.
  257.  
  258. 6.  LIMITATION OF LIABILITY. You assume full and sole responsibility for
  259. any use you make of the Licensed Software, and you bear the entire risk of
  260. any error in its functioning. You agree that regardless of any cause of
  261. any error or the form of any claim, YOUR SOLE REMEDY AND HOME PAGE PRESS,
  262. INC.'S SOLE OBLIGATION SHALL BE GOVERNED BY THIS AGREEMENT, AND IN NO
  263. EVENT SHALL HOME PAGE PRESS, INC.'S LIABILITY EXCEED THE AMOUNT YOU PAID
  264. FOR THE LICENSED SOFTWARE ALLEGED TO HAVE GIVEN RISE TO THE LIABILITY.
  265. HOME PAGE PRESS, INC. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT,
  266. CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF
  267. BUSINESS PROFIT, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND
  268. THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE LICENSED
  269. SOFTWARE, EVEN IF HOME PAGE PRESS, INC. HAS BEEN ADVISED OF THE
  270. POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE
  271. EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL
  272. DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. In no event shall HOME
  273. PAGE PRESS, INC. be liable to the end user or any other entity for any
  274. special, consequential or other damages, however caused, whether for
  275. breach of contract, negligence or otherwise, and whether or not HOME PAGE
  276. PRESS, INC. has been advised of the possibility of such damage. This
  277. limitation of HOME PAGE PRESS, INC.'S liability will apply regardless of
  278. the form of action, whether in contract or tort including negligence. Any
  279. action against HOME PAGE PRESS, INC. must be brought within eighteen (18)
  280. months after the cause of action accrues.

  282. 7. REGISTRATION. HOME PAGE PRESS, INC. is not obliged to fulfill any
  283. obligations to the end user under this Software License (including
  284. technical support) if the Software License has not been registered by the
  285. end users with HOME PAGE PRESS, INC. within 45 days of purchase. This
  286. registration will be deemed to have been completed when HOME PAGE PRESS,
  287. INC. is in receipt of the accurately completed registration card supplied
  288. in this sealed media package or in receipt of information transmitted
  289. using the software's "online registration."
  290.  
  291. 8.  U.S. GOVERNMENT RESTRICTED RIGHTS. The Licensed Software is provided
  292. with RESTRICTED RIGHTS. Use, duplication or disclosure by the Government
  293. is subject to restrictions as set forth in subparagraph (c)(2) of the
  294. Commercial Computer Software--Restricted Rights Clause at FAR 52.227-19
  295. and in subparagraph (c) (1) (ii) of the Rights in Technical Data and
  296. Computer Software clause at DFAR 252.227-7013. Contractor/manufacture is
  297. Home Page Press, Inc. 3706 North Ocean Blvd, Ste 430, Ft Lauderdale,
  298. Florida 33308.

  300. 9.  GENERAL. No waiver of any provision of this contract shall be
  301. effective unless made in writing.  Failure by either party to enforce any
  302. contract term shall not be deemed to be a waiver of future enforcement of
  303. that or any other term. The provisions of this contract are severable and
  304. if any one or more such provisions are judicially determined to be illegal
  305. or otherwise unenforceable, in whole or in part, the remaining provisions
  306. or portions shall nevertheless be binding on and enforceable by and
  307. between the parties hereto. If any item of this License shall be found
  308. invalid, the terms shall be modified or omitted to the extent necessary,
  309. and the remainder of the license shall continue in full effect. The
  310. prevailing party in any legal action brought by one party against the
  311. other shall be entitled, in addition to any other rights and remedies it
  312. may have, to reimbursement for its expenses incurred thereby, including
  313. court costs and reasonable attorney's fees.

  315. Nonperformance of either party, except the making of payments hereunder,
  316. is excused to the extent that performance is rendered impossible by
  317. strike, fire, flood, governmental acts or orders or restrictions, failure
  318. of suppliers, or any other reason where failure to perform is beyond the
  319. control and not caused by the negligence of the non-performing party. This
  320. License, including the Disclaimer of Warranty and Limited Warranty, merges
  321. all prior written and oral communications regarding the Licensed Software
  322. and sets forth the entire agreement between you and HOME PAGE PRESS, INC.
  323. with respect to the Licensed Software.  This License shall be construed in
  324. accordance with the laws of the UNITED STATES OF AMERICA in accordance
  325. with the internal laws of Florida and all disputes shall have exclusive
  326. venue in the federal and state courts in Broward County, Florida.
